Another discovery. My son took out a next account, unwittingly when he ordered some clothes and paid in full in 2009. he was 17 at the time and put his date of birth making him 18. He had no idea he was opening a next account.
He got his clothes and thought nothing of it.
However once he turned 18 he realsied he had this and used the account. because of a job loss went into default. He was contacted by Moorcroft who basically bullied him into paying half the arrears. telling him he had commited a criminal offence.
My question is should they have done a credit check on him to open the account, if they had it would have not let a credit account be opened.
Is the contract void and if so that means that technically the default has been applied to an account that was set up incorrectly.
