Good evening. This story I would say reflects on your Company Capquest its staff and it’s unsuitability as a Licenced company .
Debt Collection Agency.
I feel that the attached letters are self-explanatory. However I would like to bring these matters to your personal attention as your staff are rude or misleading or just plain ridiculous.
In July 2012 I won a competition run by Baines and Ernst to pay off all a named recipient namely *********, this was to pay off all unsecured loans up to a value of £8000-00p.
I attach the email that confirmed this fact after first contact by telephone, this was followed up by signing permission to contact and search for all creditors, including authorities. The next item received was a statement of all amounts cleared, you will see this includes a sum of £544.27p this is the amount and account that this morning your staff member stated to ******* was still outstanding a blatant lie! Please see the letter of satisfaction concerning this amount and account. Dated 3rd August 2012. The fact that your staff member stated clearly that this debt was still outstanding is a clear picture of the running of Capquest, it is fraud, it is misleading it was wrong.
Around the 23rd February 2012, Capquest phoned ****** to state that she owed a sum of £591.60p account ref ******* Account purchased from Shop Direct Financial Services. ******* informed Capquest that she had won a competition to pay off all unsecured debt and that she would inform Baines & Ernst about this. On the 26th February 2012 Capquest wrote to ****** stating in writing that they had been in contact with Baines & Ernst who had agreed to pay on the 28th February 2012 this sum in full. ******* received a letter dated the 27th February 2013 from Baines & Ernst confirming that they have honoured the debt and made arrangements to pay.
On the 3rd May 2013 ********* received another letter from Capquest stating that you could not contact Baines & Ernst, quite surprising in the face of the letters dated 27 and 26th February? Once again ******* phoned Baines and Ernst and Capquest and was told by Baines & Ernst that this sum had been paid to Capquest in full, on the 28th February 2013. Capquest never sent a final statement but I understand from searching the web that this appears the norm.
Next on the 24 January 2014 Capquest wrote to ********* stating that the account ***** in the sum of £591.60p was still outstanding. ****** phoned Nick Forrster on 0333999 7203 at 8-45am
On the 27 1 2014 directly after she received the letter. He said he would look into this especially into something called the suspense account. Today, the 28 1 2014 at approximately 8.45am Nick Forrster saying that he could not trace the £591.60p and in fact stated that the payment of an additional £544.27p was also outstanding. This account was paid in full and a copy of the letter “Letter Of Satisfaction” is attached. This is pertaining to a sum of £544.27p paid in full on the 01/08/2012. Account number Debt Managers Ltd, ******, Client Reference; *****. JD Williams.
Now it appears I have no reason to believe anything Capquest says concerning any of these amounts you claim to be owed. Your staff have been difficult, aggressive and rude, Have given misleading information and have refused to be helpful or accepting that when I signed the authority for Baines and Ernst these debts/outstanding amounts were no longer *********responsibility.
Now most seriously, ****** applied to Pay 4 later for a loan amount of £756 less deposit to purchase a Musical Instrument as a gift, this application was refused, because Capquest have been placing defaults on Credit reports for the past year, these defaults are untrue on the evidence and a libel. These should be removed in totality, to that end and because of the serious nature of these allegations in the light of the evidence I have opened a Formal Complaint with the FSA today, I have also written to pay 4 later, Experian, Equifax and Callcredit. I have also sent letters to Capquest and Baines & Ernst by recorded delivery these were confirmed as delivered this AM. Tracking numbers are available.
What does ******** want now.
Firstly any errors are the concern and sole responsibility of Capquest and Baines & Ernst. Therefore all defaults should be removed at once, otherwise they are continuing to cause financial harm and defamation (libel).
Secondly ******** demands that a written explanation is given to Pay 4 Later and also a written apology is given to *******.
Thirdly ******* seeks damages for the time cost and emotional hurt and harm caused and as restitution for the defaming defaults left with credit rating agencies. Also for the time and emotional suffering caused by these false allegations of debt and the time taken to defend against false and fraudulent allegations.
Should THE FSA and yourselves and Baines & Ernst be unable to come up with an acceptable solution to this matter, ******* reserves the right to issue a lawsuit under guidelines of the FCRA, I believe that you have breached the FDCPA.
I have also emailed this case to BBC Watchdog.
Capquest may have changed the letter heading but most certainly the vast swathes of allegations of mal practice across forums and the Internet look well deserved.
I think that's £8000 for every default. Contact OFT and Local Trading Standards. Tomorrow.
