    So I'm just after a bit of advice here now to clear my last remaining bit of debt before I become debt free.

    So back in 2012 I had a santander account, I switched to go to Barclays but after I switched a petrol pump payment for £50 went out of the Santander account that I wasn't aware of straight away, now they were adding £5 a day charges, I just put my head in the sand when I found out because I couldn't afford it at the time, owed 13.5k gambling debt now the account has remained open at -£499.50 ever since. I keep getting statement letters but since most of the balance was made up of bank charges that I think is now illegal do I have any way to either have this written off or reduced to the original payment of £50??

    When was the last payment made on the account?

    Have you acknowledged the debt in the last 6 years?

      Another question is- did they default the account? They need to have done this.

      If it helps, every six months for the last 12 years I have received statements from Santander. The account was defaulted in 2015 I think and I keep getting the letters. Never a demand for payment just the statements. It is so long SB it is not worth bothering about.

        Hi so the last payment that went into this account was on 2012 before I switched, the account has remained open just -£499.50, the same as you they have never demanded payment just sending me a statement every so often

          The account is still open.
          They haven't defaulted the account, so won't be statute barred.
          If you want finality, make a 'Without Prejudice' offer, write that on
          the offer letter to pay the £50 less the late charges.

            Before you do anything it might be worth sending a DSAR just to see if there was a default notice issued. I think pt2537 might be interested in potential unfair terms.

            it seems odd for it not to be defaulted if they are not adding any interest or charges.
