    Hi All,

    looking for some advice I’ve noted a default on my file back which has been added recently by Lowell and dated back to 2023 for £60. This relates to a BT broadband and home phone account which was opened in 2017. I left them in December 2022 and paid the bill in full. However, an oversight I didn’t return the extra WiFi discs (x2). BT never registered a default and the account was closed and up to date. I cannot find anywhere in terms and conditions or my agreement from BT that states the discs are regulated by the CCA, in fact when I login to my old BT account it specifies under the return of equipment “We'll credit you the full amount back to your account if you return equipment to us within 2 years. If your account is closed, we’ll send a cheque to your last known address”. I’m really surprised a default has been registered by Lowell for this. This is my first default.

    Welcome to LB

    BT service contracts aren't regulated by the CCA 1974.

    They are 'simple' contracts. They can default your credit file for late and non payment.

    Make a formal complaint to Lowell's asking them to remove it, follow their complaints procedure on their website, they have 8 weeks to investigate, if you aren't happy with their response, take the matter to the FOS. You should seek compensation as the Default might make it difficult for you to obtain credit. Make your case.
