    Hello,
    I have an outstanding debt with Link financial (£8,000). They cannot provide the CCA agreement and have admitted that the debt is unenforceable. Over the last couple of years they have been sending me the occaisional statement/demand which I ignore.
    I have now recieved a letter from them saying they will pass the account to Kearns solicitors if I don't contact them within 14 days.
    I would like to know if it is unwise to ignore this letter? Also, can Kearns do anything about an unenforcable debt?
    Any advice much apprieciated.

    a) I would like to know if it is unwise to ignore this letter?

    If they pass it to Kearns, then they will write to you. Before they can take legal action, they have to write a LBA, As it stands the debt is 'unenforceable', you could send Kearns a CCA request.

    b) Also, can Kearns do anything about an unenforcable debt?

    To take legal action they need to provide a compliant copy, which to date you haven't received.
