  • Collection agency - old dwbt

Between 2005 and 2010 I got myself on a mess with my debt. I has numerous credit cards and then got loans to consolidate them.
I was a really bad time for me and I was on the verge of breakdown. I was in no position to even make a token payment to the companies so I ignored it.
I moved houses a number of times but was tracked down and received lots of mail, I was too afraid to open them.
Eventually I had a bailiff turn up at the door in around 2012, he could see if had nothing worth seizing and nothing left once I had paid my essential bills.
He offered to mediate with my creditors to see if they would accept a reduced settlement, he came back with a £4,000 offer (I owed maybe £25,000). This seemed like a way of getting rid of the debt and stress once and for all so a relative helped me get the money together.
The bailiff collected the cash from my home, gave me a receipt and some paperwork and assured me I wouldn’t be bothered with any creditors again. It was a relief to not have it hanging over my head.

Now ten years later I’m getting chased for these debts again, I’ve been ignoring them as I thought they were a scam as I haven’t had any new credit for well over ten years now.

I have no idea if I was issued any CCJs but if not wouldn’t the debt be statute barred by now anyway?

I know CCJs can always be chased with new court proceedings, but seriously how many debt collectors actually go down this route?

I have no original paperwork from when I paid the bailiff as it was over a decade ago now and I don’t even have access to the email addresses I used back then.

Any advice would be appreciated - I can’t face bailiffs turning up at my new address as I rent a room in a house and have nothing worth seizing anyway?

    Thanks in anticipation

First check if any CCJ's exist, there is a small fee, https://www.trustonline.org.uk/

Once you now that, update the thread.

I’m a bit worried that by asking for my CCJ records I will end up with more debt collectors chasing me

I am assuming I have at least one but I’m guessing any will have been issued around 2011

Also complicating matters is that I’m not sure which addresses any CCJs would be registered to as I moved to much

No CCJs at the last properly they chased me at, but I moved out of there in 2013

You need to check all the addresses, you need to be sure. It's a pointless exercise if you check one address and they have a CCJ at another address.

I’ve checked my previous addresses but can’t find any CCJs listed - but wouldn’t the register only show the past 6 years anyway? Thanks

Yes, it will show 6 years, there's no way of checking beyond 6 years.

Here's the Statute Barred template, make sure you get Proof of Postage -

                https://legalbeagles.info/forums/for...ed-debt-letter

If they say they've got CCJ's, you want proof.

Wouldn’t the debt collectors have mentioned that they were chasing an unpaid CCJ in their correspondence?

                  But playing devils advocate

If I did have CCJs (which would now be over ten years old) do debt collectors actually often take people back to court to enforce it and then send the bailiffs out?

I cant see it being very cost effective for them if the debt is relatively small.

As an aside I have been able to get credit for mobile phones and online purchases in the last 5/6 years so if this an indication my credit isn’t as bad as implied by the collection agency?

                  thanks ☺️
