Debt listed twice on credit file. What do I do, default date is wrong also.

  • Debt listed twice on credit file. What do I do, default date is wrong also.

    Hello.

    Posting for my best friend.

    Yorkshire water have an account listed under 'settled' on her credit file. Originally -£264 but the last imput is £0.
    The same account appears on her default list as -£264.

    Can the same account be listed twice? The debt has not been passed on.

    Also. The initial default date was September 2016. However this is no longer visible.
    Up until now the credit score was due to increase due to 6 years passing from the date of default. How can this have changed? This was checked 2 months ago, nothing else has changed for the lady or her credit.

    Does she dispute this with yorkshire water?

    I take it that the debt was paid off?

    It can be listed twice if it been sold, in reality it shouldn't happen.

    Send Yorkshire Water a Subject Access Request, they have 30 days to provide all the details on the account. That way you can see exactly what's happened.

    Write a letter to Yorkshire Water, seeking an explanation.
    Make sure you get Proof of Postage.

    It sounds like an administrative error, they should remove it. If it is and they don't raise a formal complaint with them, if they still don't, you can raise a complaint with the ICO.

      No. She was disputing the bill and fell under hard times.

      She left the property in October 2017 and told them (but only by phone) the account however is from 2015 - nov 2018. She is going to dispite this but she has obviously no proof she even called them.

      She is looking in her paperwork today for the default date proof letter but she is 100% certain the default date has been moved forward.
      How can they do this.

      Should she report to the ombudsman too?

        Update.

        Experian showed the default date would fall off in September 2022 - 6 years from the original default in September 2016.
        It is now showing as not removing until 2025.

        However.
        Credit Karma shows the account as defaulted at the original date of September 2016. The account with both was updated on the same date july 2022.

        How can two credit companies have different information? Is this not a Yorkshire water error and instead an Experian error?

          The debt might be statute barred, if no payments and communications has been made admitting the debt in the last 6 years.

          So it might be an idea to wait until the debt is statute barred in September 2022 (as she has evidence - you need to find the actual date).

          The credit file / default can be dealt with after statute barred.

            She will have the paperwork sowewhere but she has the information from credit karam screen shot showing clearly the default date of Sept 10th 2016 - would this be enough evidence for the default date.

              Sorry another update.

              She has gone through her score history with Experian and all history shows the default for the Yorkshire Water account was 10th September 2016 up until an update on 10th of August so literally happened yesterday when she happened to just check.
              The default date has now been changed to 7th November 2018.

                If and when a SAR is sent, that will provide evidence regarding Default Notices etc. It's good that your friend has got a screenshot.

                  Don't panic your friend, but it could be that they want to get a Court claim in before the debt is statute barred in September 2022. It could be that they have sold the debt.

                    If they have sold the debt how will this effect her credit. Would it not still go from the original default date of Sept 2016.

                    She left the property in October 2017 so how can they even justify a default date 13 months after she was no longer at the address and told them of this. I thought a default had to be so many months after a missed payment.

                    Also. Even if they are looking to take this further before it is statue bared why would they have changed the default date.

                    Is it even legal to move the default date.

                      They can continue to add late markers to the Credit File. Not if there is a Default Date of November 2018.

                      b) She left the property in October 2017 so how can they even justify a default date 13 months after she was no longer at the address and told them of this. I thought a default had to be so many months after a missed payment.

                      A Default Notice is sent after 3 payments has been missed. It could be that the new occupants didn't update the water company. There could be other reasons, we just don't know. A SAR request might help answer those questions.

                      Whatever I say is going to be speculation. No it's not legal, but there needs to be an explanation as to why it has happened.
