  • Mortgage fraud...

    Hi, I hope this is in the correct place.

    My brother has obtained a buy to let mortgage to pay me my half of our parents house that they left us. He lives in the house already and has no intention of moving or letting the property once he has paid me off. As I am benefitting from the fraud will I be in trouble when he inevitably gets caught?

    What your brother does is not your concern as long as you are not part of the deception. However, how do you know that at some future date he will not wish to let the property and this being the reason he has applied for that mortgage. It would be a problem letting the property without such a mortgage so it may be that he is not telling you everything.

    As long as has the means to discharge the obligation to you, then I suggest that you don't worry about it, but do make sure that you have matters in writing before any agreement is completed

      I'm sorry I'm still not convinced.

      Is it none of my concern even if I'm benefitting from money earned fraudulently?
      Because when he gets caught it's a criminal matter and surely they will know where the money went.

      The buy to let mortgage is the only mortgage he could get that could pay me the money I'm owed, that's why he's gone for that one. Nothing to do with letting it out which he's told me he has no intention of doing. Also it's not a case of letting the house in the future. With a buy to let mortgage he won't be allowed to live there at all until the mortgage is paid off.

      I don't want any part in criminal activies.
