  • CCA vs Application Form

I a several debts across different organisations and have requested a copy of my CCA from most of them using a standard template. Opos are acting on behalf of a credit card company and are currently only organisation to send me documentation. When i reviewed the document it states it is an application form and is missing information such as ts & cs, APR, no name for the credit card company. I have concluded from my limited knowledge that it is not a copy of my original CCA or a reconstituted document.
What fo I do next? I am looking at just waiting to see what happens as my request has not been fulfilled. Or should I contact Opos after a time period. Any advice of duggestions would be appreciated.

    Hi ANDC

You could send a follow up letter stating that they haven't fulfilled your CCA request as stated in the Consumer Credit Act 1974.

Just type the following into Google 'follow cca letter', you'll find a template.

MIKE770 des8 Can you take a look and advise, many thanks.

If your debts have been assigned to a Debt Collection Agency they will need to refer back to your original creditor to obtain the required information which takes time. The time guidelines are just guidelines they are not set in stone. You should wait two months before sending a follow up letter.

unless you are being taken to court do not remind them, they know that no CCA no case, many try their luck hoping you do not know the regulations, Debt collection is borders near fraud at times. no CCA do not let them start looking for it. plenty of time in later proceedings if ever it came to it.

I agree, stay below their radar.
