  • Ccj pending help

A friend has been given notice of a court action along with the paper work from the court. She went online and said she would disagree with it and defend herself. She then sent a request to the DCA for a copy of the agreement along with the £1 PO. She has now received a email letter from their solicitor saying she doesn’t need a copy as she will have it from when she signed the agreement and the DCA have returned her postal order refusing to send a copy of her agreement.

im a little out of my depth to help her with what she should or shouldn’t do. Any help would be appreciated as it is very time sensitive. Thank you in advance

It sounds like they (DCA) haven't got the documentation they need to provide.

The following information is needed: -

    Issue Date:

    Have you Acknowledged the Claim?:

Total Amount Claimed : ( approximately please do NOT use EXACT figure given on the claim form, round up to next £100 or £1000)

    Claimant’s Name:

    Solicitors Firm:

    Original Creditor:

Original Debt (eg. Credit card/Loan/Overdraft) :

Particulars of Claim: ( Please type out in full excluding names/account numbers/exact amounts ):

Is the debt Statute Barred (have you had any contact with the creditor or claimant over the last 6 years?):

List any letters you have sent (eg: CCA/ CPR ):

I’ll follow up with the rest of the information soon, that letter was emailed to her. She’s basically hid her head in the sand regarding her debts and now she’s asked for help sorting things out.

ive been able to agree repayments with most of her debts but these are been really stubborn and causing her a lot of stress. She is on disability due to her mental health and has a limited income. Needless to say it’s causing her sleepless nights and huge stress. I’m not looking for sympathy for her and I’ve given her a hard time over the situation she’s created. But I just want to help her sort things out as best as we can. Again thank you so much for any advice your able to offer

Tell your friend not to worry. The photo you have posted is very difficult to read.

Yes sorry. They sent it like that via email. Very small print and just a photo of a letter. I zoomed in on it to read it. Very unprofessional for a solicitor!
