  • Lowell solicitors threatening court action

    Hi Guys.

    I am new here and need some help please would really appreciate it. Thank you.

    I have fallen behind with some finance I took out in May 2015 with Hitachi, in Feb 2016 I lost my position and then was the last time I was in contact with Hitachi I have been chased by a few collectors but never made contact!

    But have now been contacted by lowell now for about 10months but just ignored them "bad I know" as my financial position isn't great again due to me being laid off in December 2020!!
    Hoping to be in employment in the next few weeks!

    Last week I got a letter from Lowell solicitors saying if I don't contact them in 30 days they may take court action and could get a CCJ against me! I have £2060 on the finance but I bet they paid less then half of this too!!

    So now I'm really worried. They sent me a letter with a expenditure form attached and some tick boxes to tick etc.
    I think it's best I contact them to make sure this doesn't go to court?

    But what's the best way I hear people say don't ring them contact them by letter? I would like to see what paper work they have on this finance as I have read it is possible for them not to take you to court if they don't have the right amount of information about the finance? Using the CCJ threat is something they use to scare people !?

    Just after some advice of what's the best to do really. Don't really want to just ignore this as it's worrying me all day and night. Just want to be prepared and do the right thing so I'm ready!!

    Do you know if they have sent you a pre-action protocol for debt claims because that’s what it sounds like?

    These days the courts don't like it if you just take someone to court without first trying to resolve it without court action. A pre-action protocol will allow you thirty days to seek advice or agree a payment arrangement.

    If the reply form is not returned within the thirty days, they can issue proceedings in the county court. It’s not an idle threat, so it’s important you do as they ask if you want to avoid being taken to court.

    I would contact them in writing in any event.
