  • Halifax card advice

I wonder if anyone can give me clarity on my situation.

I have a DMP which started 2 years. Not missed a payment in 2 years.

Last year I emigrated overseas and I have continued to pay DMP with my overseas salary. This has been a struggle with conversion rates and Covid.

One of my debts is a credit card, I have had this card since 2001.

I requested the CCA to find out if it is enforceable.

The credit card company responded to the CCA request and have sent the following:

    1. Part A credit card agreement (has my Uk correspondence address not address given on application )
    2. Part B additional Important terms
    3. Conditions of use (had my old correct address from time of application).

I have not received copy of original
application, this looks like a reconstituted version.

my signature is not on any of the above.

I have not received a statement of account .

Do the documents they have sent me mean it is enforceable?

Do I need to dig further and do a SAR request?.

would be really great Uk for any wise words of wisdom.

I dealt with a Halifax credit card back in 2012. They sent me a reconstituted CCA which was nothing like the original - I know this because I had the original. They sold the debt to Cabot but it did them no good. The certainly did not get any of the £13,000 they wanted. There own fault for not keeping the agreement.

    Have you read this:
    https://www.handbook.fca.org.uk/handbook/CONC/13/1.html

It will explain the rules on the matter.
