  • Inheritance and Non Means Tested Benefits

My mother sadly passed away end of July this year.

My brother and financial advisor are executors of the estate.

Her house needs to be sold, its been valued around £525K.

She has equity release outstanding, but they have agreed to freeze it.

She has life insurance which will hopefully cover the debt.

Assets and saving also total to around £350K.

I am currently in receipt of Personal Independence Payment (PIP) and contributions based ESA.

My mother made provision for my half share of the estate to be placed into a private pension or trust fund.

I am also being given £25K in cash.

Do I need to inform benefits!?

Yes, as soon as distribution is made inform HMRC & DWP. Only any means tested benefits will be affected, so it shouldn't affect your PIP or contrib based ESA .

Any support I provide is offered without liability, if you are unsure please seek professional legal guidance.

Thank you. The financial advisor will sort out any inheritance tax etc etc.

Thank god I don't need to deal dwp then!!

The benefits I am both on are not income related or means tested.

My ESA is from contributions based, not income related.

      Thanks for the advice xx
