    I'd start with the smaller debts first to test water - don't payplan send you a monthly statement so you can see exactly where you're at with each debt, and who owns what, whether interest has stopped and so on?
    Do you have any available funds to sort out any full & final settlement payments if need be on any of the debts?

    Also on this do you have any more details of the company that contacted you ? phone number, website , company name etc ? ( and you did the right thing turning them down - was it a cold call ? or had they been given your details by payplan do you know? )
    Pay plan I can login and see debts yes, all interest has stopped on all, unfortunately we have no excess funds for full and final settlements.

    I was with nmh until last year when pay plan took over because that company was no longer doing dmp, the company cold called from details found from national money helpline, the company that called were Higgs, Newton and Kenyon. Thanks so if I do the smaller debts first , like ones under £1000. Thankyou for helping me get sorted.

      Thanks - these guys http://hnksolicitors.com/our-service...consumer-debt/ - UK Law Nationwide Ltd - they don't seem to have an FCA licence, and despite being solicitors, they still need one for debt advice - FCA ref LS 573571 ...SRA ref 573571 ..... I know that doesn't help you.... but looking at their testimonials it seems they are doing this kind of stuff a lot so might have a dig and might be an idea to check they are acting in the best interests of the debtors who got sent to them when NMH couldn't renew their licence with the FCA for debt management.

          Formal debt option - an IVA paying £90 a month isn't likely to be accepted by creditors with 52k of debt.

          I would suggest going after your oldest debts asking for CCAs first.

          If a debt is still with vanquis and it's recent, very little chance of them not having the CCA. BUT were you paying ROP on this? If you were, put in a complaint and ask for a refund, see https://debtcamel.co.uk/vanquis-rop-refund/.

            Thankyou for your reply, yes debt with vanquis still and no ROP on them, so will leave these ones till last. Â*I have plucked up courage and sent off to 10 creditors with £1.00 chequers today requesting CCA details, I have made a start, thanks again and will be touch when I get some replies.

              I think you are doing the right thing, it really is your legal right to send off a cca request and should not be taken by a creditor as any meaning of intent.

              I know, if you are not working or on a lower income the cost of sending 20 signed for £1 postal orders can be prohibitive but work your way through them.

              I think Amethysts idea to do smaller ones first was if you had excess income to make full and final settlements - as I said I did all 20 odd of mine on the same day and even the latest two ( 2010 vanquish and 2012 Provident) have had their accounts closed. I have not paid a penny to a creditor in over 6 years and don't intend to start now

                Thankyou, yes doing 10 was like £11 to post recorded as well, 10 is a god start for me as soo many I don't want to confuse who's at what stage, smaller creditors to work with first. Â*Wow you must have been soo pleased getting all yours sorted, can't wait to get through this long journey now, I think my vanquis ones are only a few years old so will leave them to last, have a few high ones but will Send them on the next round, so grateful for the support.

                  I was thinking small ones first so that if they bite back with court action, it’s not quite so potentially problematic regards the house, and yes, more likely to be able to come to some kind of settlement agreement. Just a toe dip to start with.

                    Yes a scary toe dip start for me, all the first 10 were all for under £1000 each, when I get a moment will list all the ones and amount I sent off and also the ordere which am going to send the next ten off. They should start receiving my CCA requests tomorrow onwards, so will check with post office tracked on Thursday to make sure they all got signed for as I did send them recorded, Thankyou for the support.

                      These are the ones I have sent, Cabot Financial (Europe) - husband £725.77, joint - £943.10.


                      Capital One x 2 - husband £589.93 and £605.45.

                      Hoist Financial - me £100.53.

                      Moor Croft - husband £757.32.

                      NCO Europue LTD - me £334.08.

                      PRA Group X 2 - me £247.67 and £350.95.

                      Past due credit solutions - me £568.57.


                      The CCA requests sent recorded on 12/02/18.

                        Recorded delivery printed proof of delivery, only 3 have arrived, which are pastdue, moorcroft and Cabot signed for on 14/02/18 do I now wait 12 days before doing anymore with these. The others show on track and trace as posted but not delivered yet.

                          What is your intention for the next steps ? Start withdrawing them from your debt management plan or write asking to write off or negotiate full&final settlement on the debt ?

                            I get worried if I stopped paying them through plan, so would look to send letter to write off debt if they unenforceable , my finances don't allow us to make bigger full and final figures unless they do like under 5 per cent could get maybe family to help. As this is a big step me facing the debts after so many years, I need to move slowly so I don't get panicked over them, I have found an old policy with ppi that I am following so fingers crossed there too. Thanks

                              In which case don't jump in to any action after the 12 days ( actually 12+2 for service ) for now. After the 12 days they are in technical breach of the consumer credit act and can't enforce the agreement while the breach continues ... which also means they can supply the document in 6 months time and potentially look to enforce it then. So really you want to get them to agree to write off or settle inbetween the 12 days and when they either produce the agreement or decide to try enforcement action.

                              Hope the PPI works out for you, should give you enough to get a couple/few of these smaller ones settled off if necessary. Payplan might try to get you to split it over all your debts pro rata but that's not going to get any settled and be a bit pointless.

                                Ok, so the ones that have received and singed for the CCA should I ring or write to these to get settlement / write off before the 14 days, is there a template letter for this, knew I'd be lost as to where to go for next steps, feeling worried it may flock them all to harass me which when I just done nothing and kept paying my worries were hidden, but as this is a newyearnewme I am gonna face it this time. Sorry for all the blab, thankyou so much
