I have been with a debt agency called compass for the last 8 years. Last year they went into liquidation but advised me to go with a solicitors called Abbey after 12 months the solicitors have told me that the debt companies who are chasing me for payment have no legal right as they were not the original lenders as the debt has been sold on various times is this true.

I thought those on the thread would like some further information on this. It seems like Abbey solicitors are not the only law firm involved with this. Earlier in the year I was cold called by a company called Queensbeck who work with a solicitor called Rowan Rose. I had been with Harrington Brooks in a debt plan for a number of years. Their call centre agent said that a change in the law meant that all of my debts would be completely written off. They said that they were working with Harrington Brooks to get people totally out of debt.

I had debts of £24,000 and Rowan Rose told me that these are unenforceable and would be written off. They advised me to cancel my plan with Harrington Brookes and instead pay the £270 I was paying into my debt plan to Rowan Rose. I was guaranteed that by the end of 12 months all my debts would be gone.

Well...this was nearly 7 months ago. Absolutely nothing has been done by Rowan Rose, my creditors have heard nothing from them at all. I have 3 statutory demands and am petrified that I will lose my house or be taken to court. I called Rowan Rose but was told that they don't help with stuff like that. I have paid them nearly £2000 and to date, nothing has been done. Worse than that is the fact that I am now in a far worse position than I was when I was paying my debts in an organised way with Harrington Brookes. I have asked repeatedly to speak to the solicitor who looks after my case but in 7 months have not been able to speak to him.

I am going to complain to the law society about Queensbeck and Rowan Rose but wondered if any of you guys had any success in sorting the problems you had with Abbey solicitors?

I've also had huge problems with Rowan Rose/Queensbeck. We got a call in February saying that we could just stop paying the debts as they would sort it and get them written off or something. I feel stupid for believing it now but they sounded so convincing. We had been paying Harrington Brookes for more than 5 years and their help at the time was a Life saver as the the debts we had caused me to have a nervous breakdown. They told us that if we cancelled our payments to them and paid to Rowan Rose then all of our debts would be gone by the end of the year. We had £14000 of debt and we'd paid £168 a month to Harrington Brook's without any problem. Now I dont know what to do. The plan is now cancelled and I'm left at the mercy of rowan rose. Problem is that we cant get any straight answers from them and Lowel are saying they are about to insrcut solicitors to take me to court and they will put a mark against my property so i can sell it. None of my loan companies have heard anything from rowan rose and were nearly in july. does anyone know if I can get my debt plan back up and running? Who do you go to complain against a solicitor? any help appreciated

Did you speak with Harrington Brooks at the time to check if they were aware of Rowan Rose ?
Did you have to send over all your information to Rowan or was it transferred directly by Harrington Brooks ?
Do you have copies of the client care letters / any comms from Rowan ?


Not exactly upfront about who they are - either Greenbeck or Rowan Rose. Both trading names.

Hi - Have only just seen your reply. We have spoken to Harrington Brookes in more detail since my last post. It seems that I am not the only one to fall victim to this. They have told us that they have had a high volume of complaints about cold calls from Queensbeck and Rowan Rose and are concerned that a database of their clients is being used. During the initial call, the guy from Queensbeck told us they were "working in partnership" with Harrington, following our conversation with HB, they have confirmed that this is also a lie. I've taken your advice and sent a letter today requesting my file of papers, i've also sent complaints to the MOJ and asked for their help.

I've got a copy of the initial paperwork Rowan Rose sent us and it does confirm the name of the solicitor dealing with the case. Unfortunately, we are never allowed to speak with him, instead, we only get to speak to a young lady from Rowan Rose who clearly has no idea what is going on and actually admitted to my husband that nothing is really happening with the cases and they are working out what to do with them!

Would it be possible to see the paperwork you got from Rowan Rose ( GLM Legal ) and Queensbeck ? ( Really doesn't sit well that they both use trading names )

They told us that if we cancelled our payments to them and paid to Rowan Rose then all of our debts would be gone by the end of the year.

To me that constitutes debt counselling ( ie requires authorisation by the FCA ) I know the SRA decided that Abbey Solicitors weren't Debt Counselling however we don't have the evidence that people were told to stop paying their debts and to pay Abbey instead. Anything in writing would be so useful.

Are you still paying Rowan/Queensbeck the £168 a month ?
Presumably you've had to sign some form of letter of authority for Rowan to communicate with your creditors?
Have they asked you to forward on any letters/documents you receive from your lenders?
Have you been in touch with your lenders and they've confirmed they have heard nothing ?

A database of Harrington Brooks clients doesn't just 'get used' - they must have sold the details, suffered a data breach - either by a hack or someone taking the information from the company ( like an employee etc ) - so one would hope Harrington Brooks are taking appropriate action and have informed the Information Commissioner accordingly that their clients data is at risk. Can you make a thread about that case, in the court claim forum on here, you might be able to get things held on that once we know a bit more. How much the debt is, what the original debt was for ( loan etc?) and so on.

Hi - Yes, have the paperwork, can you let me know how to get it on to here safely? I assume it's best to redact my details etc. Looking at it there is no mention that I must stop my payments to the debt plan, but the Queensbeck agent who originally called me said that I should stop paying immediately and instead pay them the money.

I agree with your comment about it being an FCA activity, my brother is a financial advisor and he told me that it probably will be an activity that the FCA regulate. I'm probably going to write to them and see what they can do. I'm still paying as worried what Rowan Rose will charge me if I stop. I did raise that point with the girl i normally speak to there, she told me that if I stop the payments the work carried out would be charged at the standard rate. The ironic thing is that they havent done anything!

When I spoke to Harrington Brooks they told me that they had not authorised either Queensbeck or Rowan Rose to use their data and were treating it as a data breach. We will see if they report that to the ICO.

I've spoken to all of my creditors and they still have not heard a thing from Queensbeck or Rowan Rose...nothing!

Can you email me ( admin@legalbeagles.info ) I know these docs can be a bit tricky to redact sometimes, so I'm happy to do it. I'd like to go back to the SRA and FCA on my discussions I was having with them about Abbey Solicitors... and point out that other law firms appear to be taking the same stance. The matter that they told you to stop paying creditors SHOULD put it ito FCA regulated territory, which they disputed previously with my complaint about Abbey. But at least they did investigate, so that is a start. Also we're trying to get a select committee going with help of Derby MP Chris Williamson over DMP's, but these solicitors/cmc's are in the mix too with regards consumer detriment, so it would be helpful for a start gathering evidence for that.

Might be worth a quick complaint to the ICO as well about the HB data being passed to Queensbeck.

The reason for us questioning the validity of the post is because Queensbeck do not cold call. We also would never state that we work with Harrington Brookes and so we regard this as a serious allegation. We can confirm that we would never advise any clients to stop making payments to a creditor. We are not entirely sure about the reference to a change in the law regarding debts being entirely written off. We can, however, confirm that debts can be challenged and we do have considerable success regarding this. Please can the person who posted the thread contact us immediately so that we can fully investigate the complaint.
