  • Ex wife has IVA … joint debt query

Hi, I’m posting on behalf of my partner. He & his now ex wife had a joint loan agreement of £24k paid over 10 years ..£100 each per month. In Feb 23 she announced she had taken out an Iva & would no longer be paying her share.so my partner has been paying the full Amt each month.

Tonight, during a heated discussion, she announced she had paid a lump sum towards to the loan & had disassociated herself from her ex husband financially.

it seems wrong that my partner is still paying the full amount.. surely if she has paid a lump sum towards the debt then the debt should be reduced? Bank will not tell him any info on what she paid post Iva but theoretically if she paid £100 lump sum towards overall debt agreement then would that not reduce the amount still to be paid?

You are correct that any payment made towards a joint debt reduces that joint debt.

The bank may be concerned that for some reason a payment made by this ex after her IVA might be clawed back or reclaimed by the supervisor of the IVA or a possible trustee in bankruptcy.
