Arrow Global/ Capquest Notice of Assignment for Lloyds Overdraft

Good Afternoon
some advice please on how to respond to a Notice of Assignment from Arrow Global.
Today I received by post a Notice of Assignment from Arrow together with a copy of a letter from Lloyds saying they have sold the debt to Arrow. The Lloyds letter is photocopied & looks odd. It's also printed on the same machine as the Assignment......
The date shown for the overdraft is 1999 . At that time the account belonged to my future husband - I only became a joint account holder in 2005/6. My husband died in 2011 & I did use the account for a while after his death but not since late 2013.
How shall I proceed with this ? Do I CCA Arrow? They have , it seems, passed the debt to Capquest for collection. I should also say I have remarried a year ago and am not known by the name that is on the letter.
any help would be most gratefully received

Update / today I've received an " urgent " text from Capquest together with a letter requesting I contact them .
should I send a CCA to get more detail ? The overdraft agreement would have been signed approx 9 years prior to my marriage . I only became a joint account holder in 2005 . My husband unfortunately passed away in 2011. Would data protection allow me access to the agreement ?

Hi,

By " data " protection" do you mean a " Data Subject Access Request" ? Fee of £10.00 payable, 40days to comply.

However the document (s) may not now be available as they would not normally be retained for more than 6 years after an account was closed.

If you were still using the bank account until late 2013 your Subject Access Request to Lloyds should include all data held on you from 2005/6 (when you became the joint account holder but not before) until it was terminated and assigned to Arrow recently.

The Data Subject Access request is " specifically " for personal data regarding the subject only 3rd party information cannot be supplied.

If the debt/account does not show on credit files it is likely more than 6 years have elapsed since the account was defaulted, all defaulted accounts are removed from CRA files after 6 years paid or not!

How many times a day are you being contacted by Crapquest?
I would in your position require them to contact you only in writing via RM post, constant calls and texts can amount to harassment.

You could try a CCA request to the original creditor in the name of the account holder, there is no obligation for a CCA request to be signed, the drawback is that many banks will demand ID before complying claiming " data protection" requires the ID.

Crapquest are calling/ texting 3/4 times a day. I block the numbers they use.
for clarity then I need to CCA Lloyds Bank ? Should I enclose a copy of my deceased husbands death certificate too ?

Hello susiec,

It's worth a try, yes send the copy DC as well.
Lloyds is well known for its " smoke and mirrors" tactics.
3-4 " contacts" a day is unreasonable! Write to Crapquest ( use signed for post) and require that all contact by phone or texts must cease as the level of contact amounts to harassment.
