    Hi,

    I have received a letter before claim for an old credit card from around 2004, payments were made via dmp until around 2014, and wondering whether to ignore the letter as I have no money to pay anyway.

    The letter says the creditor is Ex-xxx Credit card

    (it does name the actual credit card)

    the letter says 'by an assignment in writing dated the creditor assigned the debt to PRA'

    There is no date shown.

    It says I need to acknowledge the letter before 03/11/2016, otherwise court proceedings will be issued.

    All I have done so far is write asking them to confirm the name of the company who assigned it to them as it is not clear.

    Assuming they reply, do I ask for more details now, or wait to see if they do issue proceedings and ask for information then.

    Good morning,

    You need to send a CCA request to PRA together with the £1 statutory fee ( see template in the green box at the top of the " court claim" forum page) this is for a copy of the CC agreement and a current statement of the account.

    PRA has 12 + 2 Working Days to Comply. If they don't respond with a copy of the agreement within the timescale the debt is rendered unenforceable until the agreement is provided.
    Use signed for post check delivery date and signature.
    Use a postal order for the fee and mark it " For Statutory Fee Only".

    If the agreement was signed before April 2007 they must provide a copy of the original agreement not a reconstituted one.

    This should delay the process.
