Quick question for a friend in need
If an alleged debt has ben passed to a different organisation for recovery, should a cca request be sent to the original creditor or to the debt collector

Personally I would do both.

Then when the current dca gives up and hands it back to the original creditor, the debt is then already in dispute with the original creditor and therefore under OFT guidelines they shouldnt pass the debt onto a new dca until the dispute is settled.

Do they actually owe the debt though?

send to debt collector, who then forward it to the original collector. They should also have a notice of assignment. If the DCA can't get it from the original creditor, unless the debt has been sold, they will often pass it back to the original creditor. If the debt has been sold and you know this already then you should CCA the original creditor.

Not sure yet if the debt recovery people are in-house collection agency, so think its best to send to both for the sake of an extra £1
