  • Lowell Portfolio - Satisfied Default Removal Advice Requied

    Hi,
Any advice on my problem would be greatly appreciated, I have approx 16-22 months before the defaults would come off my file but at the moment the defaults are seriously hindering my future and business so even if I could get them off in 6 months or more then that would be great.

I have 2 defaults from a similar time which was due to a relationship breakdown, some bills were missed and the Defaults registered, I have since paid the defaults off in Full and they show as satisfied (I didn't know at the time I could have negotiated to have them removed on clearing the debt).

    The defaults are:

Vanquis Bank: Terms:£0, Current Balance £0, Credit Limit £0, Start Date: 16/08/2006, Default Date: 29/07/2011, Status: Settled, Default Balance £2,700, Date Updated: 30/10/2014, Date Satisfied: 30/10/2014

Shop Direct: Terms:£0, Current Balance £0, Credit Limit £0, Start Date: 11/05/2000, Default Date: 24/01/2011, Status: Settled, Default Balance £893, Date Updated: 30/10/2014, Date Satisfied: 30/10/2014

I have not contacted Lowell about removing the defaults so far.

I have contacted Vanquis and they say they have no record of my account at all (from my personal details and credit card number I had with them).

I have also contacted Shop Direct who only have details of a few missed payments and the date the account was sold to Lowell as Jan 2011.

Since this happened my credit history is very good and I have worked to keep it clean, but the defaults are still causing me major problems.

What is the best way to start asking for the removal of the Defaults? I have no idea if they were registered correctly against myself and I have no recollection of receiving any notice that a default was going to be registered against me.

As said any help would be greatly appreciated. If I am writing a letter asking for a default removal I would like to know that what I am asking for is worded correctly.

    Hi and welcome

Defaults remain on your credit files for six years after they were recorded. If the debts are repaid in full then they are marked as settled or satisfied as you describe above, however, they still stay on for the full six year period. :ohwell:

Defaults can only be removed if they were recorded in error or when the default date is incorrect and, when corrected, it means the default drops off. For example, if you had defaulted in 2008 but somehow a debt purchaser had changed the date to, say, 2011 (this does happen quite a bit, especially where Lowell are concerned :mad2), then you could get the date amended back to 2008 in which case it will drop off.

The guidance for reporting to the CRAs states that a default should be recorded between three and six months after you stop making contractual payments. If, say, you stopped paying one of your cards in Jan 2010, a default should have been recorded between April and July 2010.

      Hi,
Thanks for the Welcome and Information, I am having trouble finding out when I actually stopped paying, I didn't record it myself at the time and as previously said when I called Vanquis they said they had no record of my account any longer and Shop Direct said they had very few details on the account.
I have ordered the Equifax Statutory Credit Report so maybe that will show more detail then the online Experian one. I could possibly try and order old bank statements to find out when I stopped paying, If the original companies the debts originated with have no details then would Lowell have sufficient information?

      Many thanks, Jamie
