A Different Way To Respond To A Threat of Court Action?

I have an overdrawn PayPal account of five figures and am being threatened by Silverback Commercial Law with action within 7 days if i dont pay
Anyone had dealings with this firm?

I am nearly 60 years old and now a retired househusband,i have no income and absolutely no assets in my name whatsoever. The house always been in wifes name and she is completely unconnected to the debt. I don't even own a car..
CCJ's or bankruptcy aren't relevant to me anymore as i have no intention of applying for credit in any form in the future.
Should i still send them one of the template letters in repsonse to their assertion that i should inform them if i dispute the debt?
Or simply inform them of my situation and let them waste their time and clients money if they wish to continue to pursue?


Anyone see any downsides to this course of action? or suggest an alternative response to them?

All I can say is that I have written to more than one creditor spelling out my position, no job, on benefits , no assets and that I disputed the debt but if they thought they had a claim to make me B.R. So far not heard from them in 2 years-the debt was 15K. It is not a stratergy that I recommend but .......

If i go the letter route, as the amount isn't a loan and i haven't signed any agreements of any kind. can anyone tell me which one would be best to send please ?

What is the debt ? Paypal - is it fees, or a chargeback ? A bit of background would be useful, maybe the letter from Silverback Commercial Law would help to draft a response to them.

Hi Amethyst thanks for the quick reply, it is chargeback fees.The letter from Silverback is a typical pay in 7 days or court action will be instigated.

I seem to be very similar financially to Anfie I have nothing all the debt chaser that have come after me I have ignored as I have nothing to give them.

I suspect they can find out more about us as regards assets and wealth than we know

You're probably right Wales, "i'm broke" will be a common response so they must have ways to find out who is actually broke and whose telling porkies...lol
Have You had a law firm givng you the "7 days with no recourse to yourself " spiel?

Mrs and I have a file of threatning letters from DCAs and solicitors dating back to 2009 with the 7 day 14 day threat never been taken to court never responded to them all they are is threats and bull waste

Really???? wow .. so if you dont respond at all the chances are they won't pursue? even for 5 figure sums??

In my case they went away there were some 5 figure sums makes sense I suppose for them not to throw good money away trying to get anything out of me .

Ignoring them didnt work for me as i just received a Statutory Demand from the solicitors acting on behalf of PayPal.... It is dated two weeks ago even though it was hand delivered into my post box only today
Anyone an suggestions on how to proceed ? Got no assets , money,or job and not likely to have anytime at all in the future...
Would love to hear from others who have dealt with SD's successfully..

I would say more fool them as they have to cough up the funds however if it can be avoided so much the better

The 18 days will run from today as it was served on you today.

You need to complete the set aside form with it and get that in within 18 days.

TO do that though you will need to show there is a defence or at least a serious dispute on the debt, OR contact the company to make installment payments based on your circumstances. 5 figures does seem a lot of money in chargeback fees.
