Problem raised by Deannii

Brief Description to start

basically I've received a letter from a debt co saying they've bought my debt from another co
, the debt apparantly is a storecard from 10 years ago , which I'm pretty sure that was claered and paid off but since it
was 9/10 yeras ago i don't have any evidence to state it was paid off before the account was closed I only kept my
statements for 2 years after the account was closed , any advice ?

I had a letter about 3 years ago , and i told them then that they must be mistaken and haven't heard
anything since until now

Firstly which DCA has contacted you, can you post up further details on this please.

I would think that as you havn't heard about this for many years this debt is now actually statute barred, take a look at this letter and adapt it to suit your needs Legal Beagles if you need any further advice please shout.

They have made contact within 6 years Enaid so I`m afraid the statute barred approach is unworkable.

First thing to do is ask for a copy agreement and a copy of all statements referring to this alleged debt.
Consumer Credit Act 1974 Request for Original Copy of Agreement

Add within the letter your request for statements and a breakdown of the alleged debt.

Just out of interest which store card was it?

The debt wasn't acknowledged though. Deanii told them that they must be mistaken, but it would be useful to see the letter that was written to them.

I will try and pad out some of things that were discussed in brief to clarify situation

• Debt was paid off/cleared over 10 years ago as far as OP is aware
• DCA 1 made contact 3 years ago and were told 'Dont know anything about this' and no further contact was received from them
• DCA 2 made contact recently with regard to same debt, and now advice is needed

Do not acknowledge the debt would be the first thing - in writing to them.
