    grrrrrrrr

    This is an HFC loan that has been being paid since August 2006 at approx £5.00 through CCCS.

    Appears they have passed it on to CAPQUEST.

    Hmmm anyway this is the letter

    Balance £300ish

    It is apparent that we need to start the litigation process to resolve this matter.

    As you will be aware we have communicated with you over a period of time without the need for legal action. Costs as a result of litigation will be added to your balance, if we suceed in obtaining judgement against you.

    My name is XXXXXXXXXXX and I have been appointed your case handling supervisor (oooooooooo lucky me)

    blah blah blah

    Your case will be processed and passed to our solicitors on or around 25th Feb 08 - a process that you can stop by telephone xxxxxxxxxxxxx to discuss your account and reaching an amicable solution.

    I will not be demanding payemnt in full and I will be open to suggestions from you on how this account can be settled.

    If you contact us before 25 Feb I can offer you a settlement figure on your outstanding balance. that means you only have to pay £236.12 to clear this account with us, and if required, you can pay this over a six month period.

    You still have the opportunity to stop legal action and the possibility of settling your account over a period of time and by a method that is suitable to you.

    Soooooooooooo £236.12 over 6 months is £39.35 a month.

    Its currently being paid at about £5 through a DMP with CCCS. Sooo seems HFC have got bored of that and sold it over to CAPQUEST.

    I have no idea if theres been default notice etc etc as letters going to ex OH.

    I would guess that a CCA request is in order to stall things a little. I'm not fussed if it goes to court cause theres enough CCJs anyways. And the court will order payments at £5 a month as thats what has been being paid. But that adds the court fees etc on.

    Soooooooooo I think I need to get him to write a budget sheet and get the finances split off really. Most of the debts are in his sole name now, though a few biggies are joint names. CCCS is a joint thing.

    I don't know really. Since leaving I have kind of left it all for him to deal with which is really really bad of me I know for all my telling everyone else not to stick their heads in the sand. things tick over okay but it is getting to this kind of stage with everything.

    Sitting down and talking through money stuff isnt really a sane option at the moment so I guess I keep trying to stall things.

    Ummm so any ideas ? I'm still kind of dealing with all the finances but from a distance and without a grand deal of communication.


    All the debts, whoevers name they are in, are joint debts in reality so I don't want to just leave it all to him to sort out (appart from the fact he won't).


    So what do other people do when they seperate ? cause I really have no idea.

      Well, I would think the first thing to do when a couple separate is to talk and to talk fundamentally about financial matters, although I appreciate that this must be very difficult, but it will have to happen sooner or later.

      You say you deal with these matters anyway albeit from a distance and you also say you know he will not deal with them alone. Perhaps this is because he knows you are better able to do so than he.

      So in essence I think you know what you have to do and putting it off will only delay the inevitable.

        CCA request and reiteration of £5 a month offer to stave things off a bit.

        My thinking so far is when the house is sold it will pay everything off completely, so just stall things as much as possible until that happens. I guess a conversation would help too in the interim....

        CCCS is also due for a review so I guess the budget sheet should be updated to account for only his income, although that doesnt seem fair thats he is left paying everything - theres no way I can afford to pay half or anything even close towards the debts.

          I think if you have severed ties romantically and habitatily (not a word or even spelt right but i don't care :tinysmile_tongue_t: ), he should not be a drain on you financially either.

          I think the buzz word here is LIABILITY, you pay yours he pays his.
          That just leaves you with joint accounts. Not know the exact financial position of either you or ex, it's dificult to comment further.
          But if the equity in the property is enough to cover both your and his debts then do as you are.
          But I must emphasis your word 'stall' and not bury your head.

          Beware, the housing market is quite slow and may take some time to sell.

            Well he's decided after a 'conversation' that he's just going to pay this one off. goodness only knows how but his lookout.

            So thats one out the way.


            I have asked him to bring up ALL the paperwork next time he comes to see the kids so I'll try and list whats what then.

              I had a run in with Capquest in the last 6 months on my Halifax account, the strange thing was after they threatened all sorts with deadlines, I sent them a CCA request with a £1, they failed to send the documents (not that there was any to send) and after I got them tied up in knots they sent the papers back to the Halifax and I have heard nothing since. (fingers crossed) What they did send was the bank statements which showed all the bank charges all 18 years worth, my claim will be larger than the aleged debt. Also, whatever you do not admit to the debt when you write.
