  • Default from debt made almost solely of charges

    Hi,

I have a default of £500 for going £20.51 overdrawn in a current account. Is this legal considering most of the debts are charges?

I have a letter from NatWest saying that 'if you repay your spending of £20.51 and paid £60 towards the charges remaining amount of £470.29 would be refunded ' Therefore I have something where they admit that it is mainly charges.

This all happened over a year ago. I paid up the £80.51, but I have checked my credit rating just now, and they have defaulted me for £530 (the default was from a year ago).

I would like to state that this account is now closed, and I have written to NatWest with the above info in mind and they said:

I note your comment that the debt that the default relates to was made up of charges, as previously stated I a letter to you, the charges were correctly applied to your account in accordance with the terms and conditions. £530.29 for being £20.51 overdrawn?!?!?!?!?

But ... surely if you have written proof they would refund the charges, they cannot then go back on their word and put a default on your credit file??

To be honest, a default of £5 is as damaging as a default of £500 on your credit file, so the amount doesn't make that much difference, if they corrected it to £80.51 it would still kybosh your credit file.

Presuming that is you paid the £80.51 after the account had been defaulted.

Has it been marked as settled now on the credit file ?

Yes, its marked as settled, but surely they can't put a default on an account that is in dispute, that I was communicating with at the time regarding the debt?
