My grandfather passed away recently and I have been acting alongside my mother as an executor,everything has gone smoothlyas very small estate but we have now received a letter from the DWP which we were expecting re an overpayment of benefit.
To outline GF had been receiving the benefit Attendance allowance for a while which should have stopped when he entered a care home full time,my mother eventually noticed this discrepancy due to savings rising and contacted the Benefits DWP herself to inform them to find out why and stop it.
They thanked her but said the amount had to be paid back therefore a plan was set up with so much being paid back from his pension every month that he could afford....this went on for a couple of years with a few hundred pounds only being repaid.(still due approx 3.5k)
Grandfather now deceased this letter arrives asking for info re the estate and explaining if there is not sufficient amount in the estate to repay in full list any and all assets they had including the funeral cost.
all my GF had was approx £1500 in one bank account upon his passing and two very old life insurances which have amounted to approx £2.3k no house to sell basically nothing else at all....the funeral plus what is owed to the care home comes to approx 4k leaving my mother to find the difference from her own monies.
With all the above info can someone in the know explain what will happen next regards the DWP chasing the overpaid attendance allowance once i send them this info and my GF being deceased and which shows there is nothing in the estate to pay them???
basically is the family liable or does this type of debt die with him if not any estate left to recoup???
