  • Bryan Carters CCJ Threat

    Hi there.

Im looking for some advice here, Ive come home from work tonight with a letter from Bryan Carters Solicitors.

In this letter they have advised me that that in the next 48hrs I will be receiving a claim form for a county court summons. (Lowell debt)

This debt I believe to be statute barred, and I have fired off a letter explaining this and for them to show last payment acknowledgment.

What im not sure about is, where the Court forms will be sent to.

Im not currently on the electrol roll, as I was living abroad previously.. and have only recently moved back home.

the letter from bryan carter was addressed to my new address.. how they discovered this I don't know.

What I need to know, is if they have lodged a court summons on me, will the court use the address provided by bryan carters.. or will they use the previous address which I was on the electrol roll with last.

What I don't want is for the summons to go to a previous address, and for me to have no idea about the summons, I need to prepare my defence for this..

has anyone been in this particular situation before ?

any help would be greatly appreciated

    thanks

    james
