  • Carter Lowell - Abuse of court process/vexatious

Apologies if Cel or PT are already on this one, but wouldn't it be a good idea to compile a list of all cases where Carter/Lowell have taken a CCA claim to court without showing evidence of an agreement?

In this way, could we not gain enough evidence to put forward for them to made vexatious?

    I second the motion!

Actually, how many cases are there where either/both of them have actually provided any documents? I'd say: 0

        Surely it's worth a punt.

And then there are all the cases brought - either as Statutory Demands or as County Court claims - where the alleged debt was time barred by section 5 of the Limitation Act 1980, when a little more care would have avoided such unpleasantness and saved taxpayers' money.

Throwing my hat into the ring, I would say that Lowells are prime candidates for the Vexatious Litigants List.

The trouble would be that, if one company in the Bowells group were to be cited as being vexatious, they'd just start up another company and carry on as before.

Suspending or revoking their Consumer Credit Licence should work, though.

I'd say they win significantly more than they lose. (many by default)

This pretty much guarantees this will never happen.

Ah, if the same Directors start to turn up over and over again, that's when you suggest that they as individuals are not fit to run a business. If you could pull that one off, it would hurt even more.

And what about the solicitor who signs the Claim Form asserting her belief in the claim without ever having seen any documents to support that belief, whilst citing a claim to amounts of money that often are completely without any substance, is this not 'misleading the court'. Maybe a complaing to the Solicitors Regulation Authority would act to put a stop to this practice?
