    Okay don't panic xx 11th Feb claim issue, 16th Feb service date soooooooo 28 days is around 13 March. So yes, that is the right letter to send now to counter their response to your CPR request.

    You're doing fine


    AoS is acknowledgement of service - which is where you logged in to the moneyclaimonline site and ticked the 'intend to defend' box

      i figured out the AOS after i had sent the post!! duh silly me

      I have sent the letter to BC today- recorded of course, trying hard not to panic, doesn't help that i cant seem to shift this viral and 2 x children now have it as well, and stress of work and deadlines at uni- lol, oh well we all have a mountain of things do deal with everyday- life!!!

      Thank you so much for all your help, don't know what would have done if hadn't found this site

          Ok so i recieved a letter from BC re iterating the letter they sent re my CP 31 request and they basically will not be providing me with the statements e.t.c and to look at my own record

          Do i file my defence now?... seeing as i only have a few days left

          plz help.. dont know where to go from here

              Okey dokey, that's quite normal for that shower, have you had a read through the next steps on the guide for asking them to comply with the CPR request - you can either apply for the court to make an order that they supply the documents requested else be struck out .... or you can enter a defence basically stating non compliance with the Consumer Credit Act as well as with your CPR request.

                  ok just so im clear< i have to send the n244, witness statement and draft order by post, recorded to NCC, first thing tomorrow as deadline is 13th

                  now for the dumb Q's

                  1. do i then still file defence, hmm im guessing i dont but hey what do i know, lol like i said... dumbs Q's...
                  2. do i then just wait till i hear back from the courts, i guess i cant do anything till they respond
                  3. in the event BC dont comply.. what happens next
                  4. in the event they do,,, what happens nxt>> and i guess i pay the 80 or 45 fee?? which is fine anyway

                  or do i just file the defence anyway .. but is non compliance to provide docs enough of a defence on its own and does it carry much weight??

                  not sure which of the 2 to do (as u can probably guess), prepared to do either....

                  decisions decisions... not being able to make solid ones straight away has always been my downfall:tinysmile_cry_t:

                        im guessing i send these docs to the courts by post, first class rd 2mrrow am, does that mean i dont hav e to file a defence once thats sent???, just worried about all the deadlines and making sure i stick to them

                          You're fine, don't panic and rush it ok.

                          There shouldn't be a need to enter a defence as well as the application but a few people are doing both and basically saying on the defence about waiting for documents and have made an application under CPR 31.14 . I haven't really decided whether its a good idea or not - if you enter defence then you might have to apply to amend it later once you have the documents, although the court might just order documents then your defence amended anyway ... and it would stop any default judgment going through in error. lol, I'm as indecisive as you now

                          Witness Statement of Your Name

                          Once submitted to court then yes just matter of waiting, the judge may order a hearing to find out why you want the documents, and why the claimants haven't provided them etc oR may just make an order in terms of your draft order. sometimes they order that the claim is struck out if they dont comply within 14 days...A case bought by Marlins has just been struck out on that basis ... have a search ... I'd link but am on tablet puter which is a pain hence the typing.

                          If they do comply then you can check the documents are all compliant and in order and either aorta out a defence based on the information you have or make an admission and offer to pay. Bear In mind tho that they still haven't complied with your cca requet so if that remains in default they cannot get a ccj anyway.



                          If you get it all drafted you can post It up or email it to me admin@legalbeagles.info just to give ot the once over before sending.

                              Oh no just read ur post, done it all as u previously stated, got a friend to look over for me. Thought the same as u, didn't make sense rtto complete the defence at rthis stage... soRry using my phone to post at the mo... awful.. lol

                                UPDATE OF BRYAN CARTER AND CCJ

                                Hi all, hope you are all well

                                Well i received a letter following all of the about that this case has been sent to Croydon County Court, and received a letter from the court was a hearing date for 27th May

                                i hacve since received a letter from Bryan carter dated the 9th of May, received monday the 12th May with a copy of the credit agreement dated 2005 and a copy of a letter that they had sent to my previous address dated 13th Feb 2013 stating they had bought the debt

                                so im guessing nothing more can be done now and i have to pay this debt
