  • Orange/EE Moorcroft Debt Recovery

    Hello everyone my names Alex and I'm new to the site looking for some serious help for a serious problem.

    So I'm 21 years old and I'm in serious debt which I shouldn't and it's all down to my phone contract with Orange.

    So I had a 24 month contract with Orange which started in 2011 I missed a few payments but payed them a few days later due to payments coming out before payday, But a month or 2 before my contract was due to end, I had a phone call from Orange and basically they told me that 6 months ago 4 of my payments never went through due to a system fault, They told me the payments would of "appeared" To have gone through but actually they would of bounced... Now firstly those payments NEVER bounced, The money was removed from my bank account and never once returned, They are demanding £190.

    I have already told them I would not pay as it is not my fault and all payments on my end have gone through.. A month later (26/10/13) I received a letter from "Moorcroft Debt Recovery Limited" I will write out the letter, Please excuse the length lol.


    LETTER FROM MOORCROFT:

    "We have been instructed by EE (Formerly Orange)
    To collect your overdue debt of £193.18
    it is a legal requirement to send a notice of Intended Litigation before legal proceedings in the country court are issued.

    To prevent legal action from being taken by external solicitors instructed to act on behalf of your client it is essential that you settle this account without delay. Payment should be submitted in full to us within 7 days or contact made with this office immediately, by telephone on 0161 475 2811 or by letter with your payment.

    We would draw to your attention that if judgment and an order for repayment in full are obtained and remains unpaid it will be open to our client to consider enforcement of debt by application for other legal processes (Eg. attachment of earnings, instruction or bailiffs)"

    I have shortened it abit due to the fact it's 2:33am lol, Right know I have no idea what to do I know i don't owe orange or Moorcroft this amount of money i need help on what to do and if I am in the right, Was Orange allowed to ring me 7 months, (now 10) later demanding a payment due to there system fault? please help me!, Orange have serious messed up my credit rating so much so my rating is now in the "Very Poor" dark red.

    Does anyone have any advice, tips idea and what to do!.

    I appreciate all the help, This has got to me so much it's on my mind all day every day.

    Get a copy of your bank statement, blank out entries other than the EE ones and send them a copy and ask for their comments.

      Moorcroft are notorious for not checking that debts they handle are lawful, that the creditor has a right to collect and that they, Moorcroft have a right to collect. I had a rather heated conversation with one of their managers a few years ago, on behalf of a friend who was being harassed by them, and they seem to be under the delusion that accepting debts in good faith is sufficient, Er, I don't think so. Strangely, my friend's issue was with a mobile phone provider, but not EE.

      Follow Ostell's advice and send copies of the relevant bank statement, suitably redacted to Moorcroft. However, adding to Ostell's advice, I would also send copies to EE, also. EE have certainly fouled-up and damaged your credit rating as a result.

      See what response you get from both EE and Moorcroft, but I would be inclined to make a complaint to OFT Credit Fitness Team, who licence debt collection agencies, against Moorcroft for not conducting proper checks and pursuing an alleged debt which is clearly in dispute.
