Hi there, I originally had HP for a car with Welcome Finance through a broker about four/five years ago which I terminated under CCA section 99 VT option. Up to this point I had issues with them mucking around with DD's and I ended up having to make SO payments instead to get control of the situation. My credit file shows no issues with my account upto the point of VT and then three months afterwards a default was registered. I have since had numerous letters/demands from Welcome for "arrears" and "charges" which I have disputed each time. The amounts claimed range from about £600 to almost £1400 and then back down again showing what I believe to be clear signs of account mis-management on part of Welcome. They have tried three or four DCA's to collect these funds from me, but each time they have been sent away back to Welcome. I've only recently learned that the account was sold to Lowell about a year ago, but have only just sent me the letters advising of this! The whole situation is a shambles and the ombudsman was no use either as my complaint to Welcome (which wasn't raised by me, it was the CRA's who I chased for registering incorrect information on my file without checking who started it) was over 6 months and therefore Welcome rejected my claim with them. So....now looking to go to court but not sure if I should be taking Welcome to court despite debt being sold or Lowell who now own the debt? Also how do I go about compensation for the stress and hassle of not being able to use high street lenders due to this default against me? What about the ICO for incorrect information being held on my credit file and CRA not taking any action? Any advice appreciated. Thanks.

Can you clarify things a little here, what is it that you would like to dispute in court? Are you referring to the default recorded on your credit file or an amount of money you were charged after VT? :noidea:
If you are thinking of disputing a default in court, you may want to have a word with Celestine before you start, she's had some experience in that area. :thumb:

Thanks for your reply. :tinysmile_grin_t: Basically its the default that is killing me, so yes the primary goal is the removal of it from my CF, then looking at possible compensation and how I should approach this - is there a standard formula or claimable amount in law for this if found in my favour and do I raise this as part of my default removal claim or a secondary claim after the fact....or would this fall into res judicata realm? Also, how do I involve or ask Celestine for advice as per your advice....do I PM him/her? Thanks.
