we have come to the point where we know there is nothing we can do...we owe this money unfairly..but they coming after us for it and we really dont know where we stand...can they make us sell? or will they accept payment plan..it will take more than our lifetime to pay it all..

he did follow them.the whole incident was on cctv..husband was done with public order..fine paid on the spot...matter closed.then just under 3 years later we had a claim for injuries through the door..it all happened in 2008...we went to court in july 2012.

Why was your husband done for a public order offence when the culprits were these two scrotes? Which police force was involved, please?

our home was meant to be left as inheritance for our 3 children....it will not be worth a dime..if we have an order put on it..or even worse,being forced to sell.we will be homeless,i have put my name on the local authority housing list,just incase things go bad,but that could take years.totally at the end of my tether with worry.

i think they were represented by a no win, no fee solicitor.the ones you see on street corners,ready to ruin someones life.we had a barrister..but still lost.

south wales we live...its heddlu gwent police...he husband did hit their screen and it shattered..they didnt even report damage to car,until a week later.husband had a public order fine £70...police wasnt intereseted..just wanted matter closed.hence no court action and dealt with on the spot.

i was full comprensive..it turned out he wasnt covered third party...but he didnt ram them off the road,as they fabricated..

Are you saying that Gwent Police issued a Fixed Penalty Notice (FPN) one whole week after the alleged incident? They are supposed to be issued at the time of the alleged offence. I also find it odd that the windscreen shattered. Most cars are fitted with laminated windscreens that are designed not to shatter. Some Welsh police forces have a not-very-commendable record where doing the right thing is concerned. I am somewhat surprised a barrister was beaten by some ambulance-chasing shyster. What was the alleged offence? I am a retired policeman, btw.

the penalty was issued in december...incident toook place in march....alleged offence was public order for windscreen..then they sued us in court for personal injury.we were also taken back at barrister being beat...our solicitor said it was worse misscarriage of justice he ever saw...and the judge was falling asleep on the bench.

Was your husband driving whist ununsured reading this it looks like he drove yur car and was not insured

The FPN should never have been issued after that period of time had elapsed. This needs to be pursued with the IPCC. If the judge was falling asleep on the bench, he should be reported to the Judicial Appointments & Conduct Ombudsman (JACO), whom you can contact through the Ministry of Justice at www.justice.gov.uk. When did the little scrotes report this alleged incident to police?

If the IPCC and JACO decide to investigate, I would be inclined to seek direction from them as to what you should do about the MIB's actions. It may be that their claim is invalid due to these two scrotes fabricating a case. Not only is that Perjury it is also Perverting the Course of Justice, which is a very serious offence and, not surprisingly, carries a substantial custodial penalty. There may also be an offence of Conspiracy to Defraud in respect of the payout they received from the MIB.

Perhaps I have this wrong but isn't the FPN the very least of the OP's problems.

Isn't it the civil action that has incurred the bill.

I would be interested to know how much of this was down to the actual damages awarded and how much is costs, and are the OP's own barristers/solicitors fees included.
