  • Bailiffs threatening my daughter with plice and locksmith

    Please can anyone advise me or show me a template letter? My daughter has a parking fine which she did n't pay, to be far to her shes had ahard time, domestic violence, single parent, self employed.
    She came home today to find a letter from the bailiff saying unless she pays £400 tomorrow they will come with the police and a locksmith, she is terrifed, can anyone help?

    Have they ever entered her property made any levy on goods, given her a notice of seizure?

    If not then they would be acting unlawfully as they can not threaten to seize goods without first making a valid levy, which requires them to be granted peaceful entry on an EARLIER visit. Though they may have made a levy on the car, but a copy of the levy needs to be given to your daughter at the time it is made (or posted through the letterbox or left on the car) in order for it to be valid.

    IF they have not previously had peaceful entry to your daughters property then they CAN NOT force entry or use a lock smith. They can only force entry in such way if they had previous access to the property and a valid levy.

    Others on here are more savvy on bailiff laws and regulations than me and will no doubt be along shortly. But the above information is correct.

      In addition to Teaboy's advice, the bailiff would need a court order signed in ink by a judge to do what he is threatening to do. Which bailiff company is involved, please?

        Was the original ticket just a PCN from the the Council or a FPN issued by a Police Officer?

          Also, the OP's daughter, as a single parent, is classed as vulnerable. The local police should have records of any domestic violence issues, if it has been reported to them.

          Also, which bailiff company is involved, please?

            The company is marstons , she rang them up and they threatened her with a locksmith they told her have a warrant but my daughter says she knows nothing about it, she is very worried they told her they will add another£300 tomorrow-I've told her not to phone them and keep all correspondance in writing

                In thgat case all the Bailiff is a warrant of Execution from the Traffic Enforcement Centre, this does not carry any threat of forced entry. It does sound to me that marstons are fudging the issue and trying to charge Magistrate Court Fine Fees for PCN matters.

                Can you tell us a brief history of the ticket please?

                    She has a car which is vital to her work, I have told her to park the car elsewhere, there is no levy that she is aware of

                      Is the vehicle provided by her employer, on HP, or leased? Also, which local authority issued the PCN?

                        On the Warrant the Bailiff has will be the VRM which will be loaded into an ANPR system & if the vehicle is located then they will immobilise or remove - I assume it is the same vehicle when the ticket was obtained.

                              You said the car is vital to her work. There is a very narrow band of circumstances that cover "necessary use" and ask if you can expand on the reasons why she needs the vehicle?
