    Hi All

    I am after a little help for me this time please. My son who is 20 took out a next online agreement a few years ago. He bought something and when it came to filling in the online form he made an error on his date of birth. However he did not think anything wrong as he bought something and did not realize he was entering a credit agreement. Even with this date of birth, the account went through. When he started working past 18 he started to use it occasionally. He lost his job and i took over payments on my account.
    In march 2012 things went pear shaped for us and we were homeless for a while, staying with friends. I had no money and was ill. (I won't bore you with details)
    We had our post re-directed and as far as i am aware we had not a great deal of the post. In November he got letters from Moorcroft, he ended up paying them £350 towards the £700 debt, because they said he had committed fraud and the only way to freeze the account was to pay half.
    I was not happy, I contacted them and they could only supply a screen shot of the computer page, not even my sons.
    It has appeared on his credit file. I wrote to them and asked them to consider a 50% offer in return for settlement and removal/adjustment of my son's credit file to ensure his credit rating was good. They have accepted the offer but not the adjustment on his file.
    I thought in my limited knowledge that they should have credit checked and if so fail it. He is mortified and panicking about it and what Moorecroft have said.
    Any pointers on this. As he has applied for an overdraft and it might be this one thing on his file.

    Who owns the account now?

    Has the account been defaulted? If so, what was the default process?

    Have charges been added to the account? If so, what do they add up to?

      Hi apparently Moorcroft owns it.

      As for the default, I am not sure, certainly received no paperwork with it. I have haggled the charges and the orginal debt was 700 and they had 350 already ......
      They will accept 175 to settle, but in the letter i asked them to adjust credit record. A long shot, but the date of birth issue should have flagged up, or am i being naive

        Did you receive a letter from the original creditor saying they had sold the debt and closed the account and notifying you that the debt is now owned by Moorcroft? The Notice of Assignment letter, or did Moorcroft just write to you out of the blue?

            I'd say they dont own it then as you didnt receive the Notice of Assignment. Moorcroft are probably just chasing it on a no win no fee basis. If they are implying they own it, ask them for a copy of the Notice of Assignment as you never received one. You need to be sure who you owe the money to.

              Moorcroft were chasing my boyfriend for a alleged debt we have thats in dispute, I wrote to them about the dispute and they replied saying their client had advised them to keep chasing the debt and gave us 14 days to respond. I thought it was strange they gave us 14 days to respond since their first letter was all threats so I ignored it and never heard from them again.

                Can I ask how old he was when he took the agreement out and what year it it was, it may be relevant.

                  Not withstanding any of the other lines of query here, any offer to settle for a % should be base on the actual amount owed, with all the charges removed. Do you know exactly what the charges add up to?

                      I take it the file is just marked as a default(d) or has there been a judgment?

                      In either case they will not remove the marker from his file no matter what they say, if it was correctly placed after default.

                      I can see no advantage in you paying any more money to them to be honest particularly if money is so tight at the moment.
                      The allegations of fraud are just being made to scare you and have no substance, the fact is that they should have checked his application before the credit was issued anyway, no one is going to be interested in any criminal implications over such a small amount in any case.
                      The marker will drop off his file in 6 years from the date of default.
