  • Welcome secured loan-advice please!

    Hi all,
    Have seen the help that other people have had,and hope someone can help us!
    Will try and keep it short...
    Please bear with me-not 100% on some dates!
    Took a secured loan out with WF in 2005.Payments made on time every month.
    In January 2010 my hubby got made redundant.We claimed on the PPI and the insurance company paid for the first 12 months. We then had to make payments ourselves.Hubby couldn't get any work so tried to go self employed but didn't get much work.Because I work-I'm self employed-we couldn't claim any benefits;just council tax allowance and a bit extra working tax credits.We tried to make a payment every month,but sometimes we couldn't pay the full amount.After 12 months,we were able to claim on the PPI again;Welcome now want their money again as from February.
    I spoke at length with someone from Welcome last week and explained that hubby was still out of work-I offered to pay £200 a month (our normal payment should be £396.00) which was accepted;a direct debit was set up over the phone and the girl i spoke to said we needed to complete an income and expenditure form to see if we had that amount available every month.
    We filled the form in and sent it back.
    Welcome have phoned today to say that the offer of £200 was being declined-because we'd put down monthly payments to a credit card and 2 monthly payments to catalogue companies and that money should go to Welcome, not those 3 companies.My hubby challenged them and said that the credit card and catalogue companies still had to be paid though Welcomes reply was to stop paying the 3 companies,tell them we cant afford it and to offer £1 a week-welcome said that they would have to accept it as its an offer of payment.
    Obviously, we don't want to do this-it would take forever to pay off,and look bad on our credit report.
    Can Welcome do this?
    And if we've made the offer of £200 which we can afford at the moment until hubby gets work,do Welcome have to accept it? Surely they can't repossess if we're paying something,even if it's not the full monthly amount?
    We're due to ring them back in the next couple of days so would like to know what we're talking about when we do!
    by the way,should they have told us they'd gone into administration?We never even knew until we found this site!

                    The advice offered by debt management companies is to treat any secured lending as a priority debt, so they are correct in what they say.
                    Your first priority must be to protect your house.
                    Yes your CRA file will be trashed for a few years but at least you will have somewhere to live.

                    If the agreement is a regulated one (under 25K)it may be worth having a look, to ensure it is Kosher(enforceable).

                        If the loan was under 25K pre 2008 it would be covered by the consumer credit act.
                        This act sets down requirements for the form and content of the agreement, if certain prescribed elements are misstated or not there the agreement becomes unenforceable in court.

                          Lisa, please also check with Land Registry whether they have a charge on your property. I have a 'supposed' secured loan with them however they have not registered their interest on the Land Registry Records in any shape or form so the loan is actually technically unsecured. Its worth the £12 to do the search. It certainly was an eye opener in my case. I also never signed a standard security document. Welcome's administration is sloppy to say the least and they have tried to cover it up with their bully tactics.

                            Please note Rubys post, the alleged loan they state I have no documents and they are not on land registry documents.
                            Watch though for mention of Progressive Finance as this is also one of the names they have used.
                            Try not to let them bully you, easier said than done I know but united we stand etc!

                              So if I stick to my guns and say that we are only going to pay £200 a month (and this,hopefully,will only be temporary until hubby gets work),do they have to accept it?
                              Surely if they say "No-if you can't pay any more than that then we'll take you to court" then any reasonable judge will say to Welcome "They offered you £200 a month so you have to accept it" rather than try and repossess us?It's not like we're not paying anything at all!
