    This thread is an update to an old thread I posted regarding a default that was registered with the CRA and Aktiv Kapital.
    After months of disputing this with Aktiv Kapital I did report them to the ICO.
    They admitted that they hd been acting on wrong information and that they were sending documents to the wrong address. Tey also showed a Nill outstanding balance on the letter.
    Relieved that finally this matter had finally come to a close, I checked my credit file it was clear and I was able to get credit.
    But just before xmas I applied to the bank for an increase on my overdraft and was amazed to find that the default was back on.
    When I spoke with Aktiv Kapital they told me that because the ICO never mentioned changing the balance.
    I have now written back to the ICO because they are holding my complaint on file and hoping that this will be dealt with quickly.
    Can anyone advise me on whether I should now take court action against Aktiv Kapital for the stress and anxiety that they have caused. They should be able to treat other people in this way.

    Section 3, Protection from Harassment Act 1997, provides that a person being subject to harassment by an individual or body corporate may seek damages against the individual or body corporate for anxiety caused and any financial losses incurred. AK may not wish to have the High Court ruling in the case of Ferguson -v- British Gas Trading [2009] thrust in their face, but it will remind them that they are not untouchable and the law will have its way and that they cannot bully, harass or intimidate individuals.
