    Hi, It is my first time here.

    At 21.11.2012 received letter from Inter Credit telling me to pay 80 Pounds for not having Taxed Vehicle over two years ago. After contacting the we agreed that i will pay this in instalments. Last week i have paied whole amount. The problem starts when on 21.12.2012 i have recived letter from Marston Group Limited telling me that i have to pay 335 pounds for something. Quoting Ref number on letter and as their customer on letter was HM Courts & Tribunal Service.

    Letter said :

    "We are in possesion of a Magistrate's Court Order as a consequence of non payment of above fine. Your Resudence at the above address has been confirmed by Marston Groups tracing & investigations unit. As you have failed to deal with this outstanding fine or respond to letters delivered to this and/or your previous address/es, we must inform you that unless the TOTAL sum due is paid within 7 days of this letter, our bailiffs will attend to levy distress and remove goods for sale by PUBLIC AUCTION."

    After try my best to contact Marston under number provided fist try Lady on the other side told me not possible for dispute and she put phone down. Second try Lady told me only that this fine is for "not providing correct information about vehicle i used to own" than she asked me do i want to pay when i said no she put phone down again. I rang DVLA collection departement and they confirmed that i had only one fine to be paid for them 80 pounds which i started to settle as above.

    They left me with no chance to speak with anybody as i received letter on friday and now their offices are closed.

    For me it looks like someone passed my data to Marston which collect fine for the same thing as i dealt with InterCredit already. As i found on internet i can not be fine twice for the same thing.

    What i have done i paied this fine yesterday, as i was affraid of this thread of bailiffs coming to my home or my credit score would be affected by not paying. Also i have been left with no chance of deffending myself as MArston Group was closed for Christmas time.
    Can i somehow request my money back from them if they forced me to pay for same thing again.
    How can i legaly request what information they posses about me and force them to give me my money back.

    Sorry for not clear language.

    Looking forward for any kind of help.

    You cannot be forced to pay the same fine twice. You need to speak to DVLA asap and find out exactly what is going on. It may be that Inter Credit passed your details to Marston Group. What you need to establish is as follows -

    1. Did DVLA authorise Inter Credit to pass the matter to HMCTS?
    2. Why has the matter been passed to Marston Group when the fine had been paid in full, as agreed with Inter Credit?
    3. On what date did HMCTS register the alleged fine?
    4. What authorisation has Marston Group been given to pursue this matter, e.g. Distress Warrant, and, if so, on what date?

    Marston Group have a contract with HMCTS to collect unpaid court fines and this contract restricts fees to £85 administration fee and £215 attendance/visit fee. Unless Marston Group have physically attended your home, they cannot charge the attendance/visit fee. Marston Group are known for dishonesty and violent behaviour on the part of their certificated bailiffs.

    Chase this with DVLA, in the first instance, establish what is going on, and take it from there. However, do not rule out that someone, somewhere, has cocked-up, in which case, Marston Group can be told to go swivel.

      One thing that does confuse me is that initially you say you were done for no tax - chased by Inter Credit, then done for not providing information, I assume Keeper's information - chased by Marstons. This to me is 2 different offences & may explain what is happening.

          Thank you very much , will check with DVLA tomorrow as today they are closed and find out who passed information to HMCTS, and as PT highlighted wasn't it two separate cases. But they received V5 on time as far as i am concern, and DVLA already told me that there was only one case on my name about this road tax and nothing else.
          I had got into Marston today as well and if that was about same thing trough court i can request for my money to be return in total.
          Also could it be possible that because i agree in first place with Inter Credit to pay in instalments cause the situation that my case was open and passed further???

            In particular with Marstons have you asked what address they have on the Warrant or better still ask to see a copy of it - they have form for different addresses/names. Have they also told you which Court this was heard at, it would pay to check with them also. The way I see it is that Inter Credit are acting purely as Debt Collectors whereas Marston are operating on behalf of HMCTS who appear to have a criminal conviction against you.

              Finaly, have riched HMCTS in my city, what a nice service. Lady on the othe side told me that penalty was about not informing DVLA about change in address on my registration certificate V5. AS PT told previously in Reply No3 that was my bad, and i was fined accordingly, and as Bluebottle said Marston chrged me exactly 85 pounds and fine was 250 which give together 335 which i had to pay.
              PEOPLE PLEASE DO NOT HESITATE TO INFORM ABOUT ANY CHANGES IN YOUR ADDRESS TO DVLA SUCH A TRIVIAL THING COSTS ME 335 POUNDS AND MORE HEADACHE THAN THAT WAS WORTH IT.

                    HI PT, i moved to new address, and for 5 months before i sold bike there was no road tax and no insurance, and i have changed address on my license but forgot t do so on registration certificate. So i was done for not changing an address.
