      Hi enquirer, I have revoked their right of access 3 times by recorded delivery and several times by email

        Thanks teaboy2. I have sent Barnaby another email and have forwarded emails to Samir. I also have emailed Neil who has also read my emails. I will keep all the email read receipts as evidence for my complaint to credit fitness at the OFT

              I understand your concern to be that you are disputing the debt and also you would like us to only communicate with you by letter. In addition to this, you are also revoking your doorstep licence. Firstly I can confirm that we have now removed your contact telephone numbers and email address from our records.

              Having now had the opportunity to fully review this matter I have determined that the loan of £xxx was originally issued to you by xxxxxxxx in xxxx 2011 and we purchased the debt in xxx 2012. The current balance is £xxx.

              I note from our records that we provided you with a copy of the original loan agreement in September 2012, and I also enclose a further copy for your ease of reference.

              In relation to your notification of your revocation of the doorstep licence regarding out intention to send an agent to your home to discuss the debt, I can confirm that we are fully aware of this and we ensure that we fully comply with the OFT guidance regarding debt collection and visits by agents. We have therefore noted our records to reflect you would prefer an agent not to call regarding this debt.

              We will to continue to pursue you for the outstanding debt and request that you contact us within the next 14 days with your payment proposals before we take further action to recover the debt. If we do not hear from you we may apply to your local county court to obtain a county court judgement (CCJ) for the outstanding debt. The costs associated with this action will be added to the outstanding debt. Once judgement has been obtained we could ultimately then refer the matter to the court bailiff to attend your property to recover the debt.

              We would prefer not to have to pursue this natter through the courts, but your continued refusal to discuss the debt with us, will force us to take the above action. Please contact us on 0800 xxxxxxx to discuss your payment proposal

              1. The copy of the original loan agreement is not dated
              2. I dispute the alleged outstanding balance amount & have asked for a full breakdown of how this figure is achieved.
              3. Despite my records being noted that I would prefer an agent not to call at my home address and despite several emails and letter requesting the same an agent called at my address yesterday.
              4. I have refused to discuss the debt!! I have a paper trail to prove otherwise/
              5. MMF are fully aware and ensure they comply with the OFT debt collection guidelines.... REALLY!!!!!

Me thinks they under some pressure as them complying is unheard off} with the OFT guidance regarding debt collection and visits by agents. And they telling you to rest assured they do comply lol}

                    I also recieved a similar letter , after emailing Barnaby and telling him i wanted nobody knocking at my door.That was over a week ago , and i'm waiting for the third hand written letter to come through my letter box.

                      I have already offered an affordable and realistic repayment plan twice, however MMF have chosen to ignore my offers.

                      I am writing to Barry again with some pointers and an offer of an affordable repayment plan on my terms & conditions and I will only be paying the amount which I believe I am liable for.....

                        Trespass is a civil matter not a police one. The Police would only become involved if there was likely to be a criminal offence committed sic as a breach of the peace or an assault.

                          A trespasser who refuses to leave (this is a de facto Breach of the Peace), is a legitimate reason to request police assistance. They will remove him from the property.

                          And that's before we get into the question of Harassment. Calling the police is useful, not only because it gets rid of an obnoxious idiot, but because it creates a paper trail that can then be used for a variety of complaints.

                          I would also submit that ...

                          If a DCA goon enters onto the land as a trespasser and then engages in certain conduct, for example, shouting through the letterbox, kicking or banging on the door, with the intent that their actions will be intimidatory, obstructive or disruptive, so as to cause the householder to stop what they are lawfully doing, he will be committing an offence under s86(1) Criminal Justice and Public Order Act 1994.

                            Yes but it does not actually become a police matter until one of these events occur. If he arrives as a trespasser and leaves when asked then no offence has actually been committed under criminal law.

                              If the goon comes up the path either tell him to -off or ignore him talk of police is ridiculous if by chance they catch you off guard they cant talk to you about any akkeged debt without acertaining you are the alleged debtor if you do not answer questions he will go away probably never return,i gree with taking action if they persist in phone calls letters can be destroyed or left unopened there is a return address on the envelope of most debt letters if you ignore them they will go away if you cant pay or the debt is not yours there is very little they can do

                                MMF have replied and they have said "We have noted our records to reflect you would prefer an agent not to call regarding this debt" However I will take this with a pinch of salt as it is evident that MMF play by their own rules despite claiming that they are aware of the OFT guidelines for debt collection.
