    Hi all after a bit of guidance on the best course of action. In march 2007 I got a ccj issued by a firm of solicitors (for their overpriced and pointless divorce 'charges'). I didnt attend and they got a default forwith ccj for 3899. Some time later (about a year) a dca started chasing it and I paid £100.......it all went quiet again.

    About a year ago the DCA started chasing me (Clear debt) again but this time the supposed creditor was a different form of solicitors so I queried this which really confused them. Eventualy they advised the new form had aquired the old firm and they are entitled to collect the debt of just over £5100 (ccj was 3899 and I paid £100). I asked for evidence of this as I had not be notified and I never heard back.... until today. Again asking for £5100 for this other firm.

    I am tempted to go back to the court and ask them for a 'varied' payment plan and for them to clarify ownership, but will this reset the 6 year drop off your credit file clock????? Should I even reply to this DCA (guardian recovery) and whyt has it gone up so much...... I didnt think they could add interest to a sub £5000 debt, surelt this isnt charges ???? Their site states no success no fee

    the ccj will drop off your credit file after six years, paid or not

    their is nothing to reset once a ccj has been granted

    the resetting thing you are talking about is the statute of limitations where a creditor has had no acknowledgement of a debt for a period of six years from cause of action

    that would be when you missed the last contractual repayment

    this is all prior to the ccj being issued and has no relevance in your case

    you will be free of the ccj etc after a six year period from your credit file

    they cannot add post judgement interest unless it was in the actual judgement which i very much doubt

      Thanks for the reply. I get the 6 year thing but was concerned that if I 'vary' the order with a payment plan it will reset the time thing. As its a CCJ the limitations act wont apply and they can chase me.... but surely they have to prove they own the debt (new solicitors) / get it transferred to them, and all those costs ??????

        well yes

        if a different company is in effect is chasing you, they have to prove the right to collect on that debt, even subject to a ccj

        you need to get them to confirm under what authority they claim the balance in that they are a different creditor/solicitor who obtained the original ccj
