  • Harrassment during debt dispute

    Hello. I have come to this site to ask for help as regards an ongoing debt problem and I could do with some advice.

    In 2009 I had a debt with Nat west bank which I could not afford to pay, so I left the bank and started paying them back through a debt agency called Gregson and Brooke. After a year of payments, they phoned me to say that they (G&B) had had a call from Natwest saying my debt had been written off and that I should stop paying them.
    Although very delighted I did ask for written proof of this but the assistant said she had asked them many times and they had not given any but I was not to worry because they had the conversation was recorded.
    Two years down the line and a house move, a business called Capquest wrote to me to say they had bought the debt from Natwest and since then have been harrassing me with many daily phone call.
    I contacted Gregson and Brooke and their complaints dept have been trying to help me warning Capquest not to harrass me while this debt is being disputed.
    Gregson and Brooke have also been contacting Nat west bank asking them for the original agreement of the said loan agreement and they are not complying with the request. Gregson and Brookes legal dept said they cannot harrass me until that agreement is proved so it is still ongoing.
    Meanwhile there are still 3 or 4 Capquest call per day! I do not answer the phone and have it blocked on my mobile.
    I did take this problem to CAB last year and they advised that I pay them back on a DRO at the smallest fee they can accept as I am a pensioner and am on a fixed income.
    I dont know whether to fight on or accept the DRO method. Meanwhile CapQuest is causing me a lot of stress.
    Please can you advise me.

    CapQuest are bullies. Gregson & Brooke are correct in that Natwest must produce the original agreement - or a certified copy of it - and CapQuest must not engage in any conduct which amounts to harassment whilst the matter of the agreement is being dealt with.

    I am attaching a copy of the OFT Debt Collection Guidelines which will show you what rules debt collection agencies are required to abide by. If you have any more problems with CapQuest, please come back onto this thread and we will help you with making a complaint to the OFT's Credit Fitness team, who monitor the behaviour of debt collection agencies.
