    Hi all,my first post and can i first say,what a great site,with a wealth of information.I would like some advice on my debt situation with MMF.I took a payday loan out last year,and in the mean time moved home,due to relationship breakdown.I have recently been contacted by MMF,firstly by email 2 weeks ago,then today they phoned my employer and left a message saying Rob from mmf is visiting my property today.I only found this out when my employer phoned me on site and told me,and asked me to phone them.I did phone them and said they had broke Data Protection by saying they were a DCA ,the reply i got was that my work number was on the credit agreement(which it states next to it on the agreement)and their system can not tell difference between home and other numbers.I told them i have no contract with them and to send a copy of agreement,which they said i have to pay £25 for admin costs.I then hung the phone up as i did not want to say anything if it was being recorded,but they said they will visit my property,what should i do next please....?

    that a poor excuse and does not wash

    MMF have your home, mobile, and work number which would be on the agreement you signed with the pay day loan company

    them phoning work is an old trick, they had no lawful authority putting your work number into their automatic dialer, data protection act 1998

    enquiries@oft.gsi.gov.uk

    you need to send an email complaint to the office of fair trading, in the subject box of the email put credit fitness

    tell them they are phoning your place of employment talking about a debt to unathorised persons and you consider them to be acting in contravention of the data protection act

    tell them you feel ashamed now at work due to them revealing a debt collector has made contact

    this lot will be closed down soon so its most important you send the complaint, do it now

      This document takes you through the process of complaining to OFT Credit Fitness Team. I know it's for bailiff companies, but the process is identical for DCAs. It helps a great deal if you can quote a DCA's OFT Credit Licence Number.

      As Miliitant has said, MMF are heading for closure and I would not be surprised if they were made the subject of a Compulsory Winding-Up Order.

        Johnny i have MMF's Managing directors email address if you like i can email him on your behalf if you can pm me the your details and the details of the payday loan - They'll back off once i email them.

        For a start they have no legal right to charge you £25 for the agreement as the statutory fee is £1 - So that's possible fraud for a start, if that's what they told you.

        As for ringing you at work, well i think it would have been obvious it was a works number when answered on when the voice mail message states company name, should that be the case. In any case, whether they are aware or not, the onus is on them to ensure they do not breach the Data Protection Act 1998, therefore a simple check will have determined if it was your home or work number.

        I've had dealings with these idiots myself and found myself explaining the law to them regarding credit agreements as they simply don't know the law - They are, quite literally, a bunch of cowboys! And yes i give them what for too.

          Is this Motormile Finance. If so they are the biggest bunch of Juan Kerrs that I have ever had the fun of dealing with. They are so pathetic that the make Muck Hall look professional. I have built up a sizeable dossier of text messages recorded phone calls etc in which the break ever rule in the book. They have made so many empty threats and promises to call me it's gong to be fun seeing the in court as defendants not plaintiffs.

                What about this line from one of their threatomatics.

                We hereby formally invite you to provide a suitable appointment time and date to prevent our agent from arriving unannnouced and potentially causing you any embarrassment. ............


                They then go on to say

                If we do not hear from you then the account will be passed to your local Home Visit Division who will attempt visit during the day, on evenings and weekends until such times as they can make positive contact with you..



                Now just how many of the OFT Guidelines have they broken with these two lines not to mention breaches of CPUTR and possible criminal offences.

                Personally I am trying to work out whether its arrogance or just crass stupidity

                  They have been threatning me with a home visit for the last 12 months

                  not once have i replied to their threatograms until they start following the law of the land

                  next it will be northern debt recovery and marshal hoars baliffs who only exist on paper

                  i would just ignore the toe rags and keep a record of the email/letter they send, its all evidence and please report to the OFT on the link provided

                    NDR They are a joke. Had them a few years ago chasing a catalogue debt.

                    I agree with you about ignoring DCAs. These feckers have given themselves so much rope that they could hang the whole firm. I havent even opened up the Beagle Armory yet of CCA requests, formal complainst to them, demands for proof that the debt has been legally assigned, making sure they realise that if they purchase the rights of the debt the also purchase the responsibilities of it.
