Okay, got it now, thanks for your patience with me - apologies for being dense, stupidly busy at work and now anxious about this, my brain just isn't working straight.

So, I need to submit an N244 (and £80) to the court - would that be Northampton? Or is there some mechanism for doing so via MoneyClaimOnline? I imagine my reasoning would be similar to the example you've kindly given, except I can ignore the bits about wanting an extension?

To be honest in your case i would send uncle bryan an email stating that you are more than happy to argue this out in court, these offers are made if they know they cant confirm a victory. Carter as a rule will withdraw

if he does not then go in with the n244 applcation

thats what i would do in your situation but only you can make that choice

Okay, I'm quite happy to argue this out, as he's not supplied the documents I asked for in my CCA request of 7 September. Could you be so kind as to comment on the draft letter I am planning to send? Re-reading the letter from Carter, it's headed "Without Prejudice" - what is the significance of that, if any?

I DO NOT ACKNOWLEDGE ANY DEBT TO ARROW GLOBAL LIMITED OR ANY OTHER COMPANY OR ORGANISATION THAT YOU OR THEY MAY BE ASSOCIATED WITH.

Thank you for your letter of 14 September, the contents of which are noted. I am disappointed that no reference was made to my letter of 6 September to yourselves, where I requested - as if my right - a true and legible copy of any credit agreement related to this alleged debt, and I wish to draw your attention to your company's lack of compliance with my reasonable request.

As you clearly cannot prove that this ALLEGED debt in anyway relates to me, I am quite prepared to present my case in court where I will ask for the case to be struck out.

I await your response with interest.

me thinks carter does not have the agreement

head your letter without prejudice also

it means that the letter cant be used in court unless both sides agree

Well, miliitant, what is it like to be psychic? I now have a letter from Bryan Carter saying that they "are no longer instructed in connection with this matter and have returned the account to our client."

I guess I wait now for Arrow Global? Who likely don't have the agreement either because I haven't heard from them with the details I requested and I sent the letter (via Carter) over a month ago.

Arrow Global have now written to me, regarding my defence filed at court, stating:

"We enclose a Notice of Change by way of service upon you, kindly note our details.

Your defence states that you are unaware of the debt due, kindly note:

1. This account relates to a Halifax current account overdraft;
2. The account originates from XX July 1996;
3. The account defaulted on XX July 2008;
4. Arrow Global acquired the debt on 08 August 2010 and a Notice of Assignment was served on 20 January 2011

Kindly contact us to resolve this matter amicably to prevent legal costs being incurred."


Now, I don't know what to do - the defence is in at Northampton, but what is happening there? Arrow Global haven't given me what I asked for in my "Prove It letter" which went via Bryan Carter over a month ago - should I just repeat/re-phrase my letter to Bryan Carter?

My defence stated:
I am not aware of any outstanding debt to "Arrow Global Limited" and do not acknowledge the same. I have not been provided with details of the alleged debt nor have Arrow Global Limited properly identified themselves to me. As matters stand, I believe that this claim has been issued in error. I have been issued with no letter of assignment of this alleged debt by this, or any other agency, and I request that the Court puts Arrow Global Limited to strict proof that the alleged debt exists, is legally enforceable, and if so, that Arrow Global Limited have any lawful right to pursue me for it. Attached is a letter to the claimant's lawyers asking for details so this may be resolved."

As yet, nothing re my CCA request from the lawyers given the heave nor Arrow Global...

So will the AQ just come from the court at some point or is it something I have to apply for? I'm really shocked that these people get away with trying it on - and the banks must know that they do so. Don't the banks care about their reputations? (rhetorical question!)
