    Hi all
    Just thought Id share my latest experience with the Leeds losers
    Having had a financial blip I wrote to the the above telling them I was making a lower payment they screamed blue hell and sent me all sorts of letters threatening me with court action and checking my credit file to see what assets I have Blah blah
    I ignored them and paid my reduced payments I`m now back paying my original offer after writing to them but they now say I have not corresponded and will be stepping up collection activity and will be checking my assets to decide whether to commence with legal action
    If I`m paying them have they any rights to do any of the above and why do they insist on sending loads of letters
    Should I ignore them still
    Its a very old littlewoods finance account that was passed to Barclays then onto Lowells

          The Leeds Losers will huff and they'll puff but they won't blow your house down. Ignore them, maintain your payments. Presumably you 'adjusted' the payments when you were struggling by notifying them in writing. You then recommenced 'usual' payments once you were able. Perfectly reasonable conduct. You may get a few more phone calls which you should terminate and ignore.

            Bombarding you with threatening letters is a breach of Section 2, Protection from Harassment Act 1997. It is also a breach of Lowell's OFT Licence under the CCA. As Celestine has said, you have acted perfectly reasonably and properly by informing them, in writing, that you were having financial difficulties and were reducing payments temporarily until your financial situation improved, which it has and you have now returned to paying the more usual payment.

            If you sent all correspondence by Recorded Delivery and have records of this, including proof of receipt by Lowells, I would be inclined to make a formal complaint to OFT Credit Fitness Team by email to enquiries@oft.gsi.gov.uk and insert CREDIT FITNESS into the subject box. Give a clear and concise resume of your complaint and include the following details in your complaint -

            Company Name: Lowell Financial
            Credit Licence No.: 0528607

            I am attaching a copy of the OFT Debt Collection Guidelines which you should study, identify breaches and list these in your complaint to OFT Credit Fitness Team.

            My gut-feeling is that you should sent Lowells a Recorded Delivery Letter putting them on notice that their behaviour is being brought to the attention of OFT Credit Fitness Team and list the breaches. You should also put them on notice that their correspondence contains threats which amount to breaches of Section 2, Protection from Harassment Act 1997.

            There is a civil remedy provision under Section 3 of the Act which allows you to obtain a "without notice" injunction against Lowells should their threatening letters become a problem. There is also case law in the form of Ferguson -v- British Gas Trading Ltd 2009 that can be quoted if necessary. This case means that companies can be proceeded against for harassment of individuals.

              Just an update
              Received a letter from Lowells they have sent my complaint to their special complaints department have put my account on hold and will be in touch soon
              About bloody time they admit to getting my letter THANKS BLUEBOTTLE for the advice

                Special Complaints department, means Biased lowells always right deparment after account on hold for 30 days - 6/12months. Then when they think you will have forgotten about it, they will start again.
