  • Trevor munn solicitors threatening letter

    Hello,

I would like advice on what to do about this threatening letter I got from Trevor munn solicitors today. The letter says that they can now take me to court if I don't pay £120 within 10 days. The reason they are on my back about this is I was with Swinton insurance for a past job I i cancelled my account with them when I finished the job at the time they told e it would be £50 to cancel but sent me a letter saying I owed them £90. I phone them up and was told that i didn't owe anything and that my account was no longer in use. So I left it and about a month later I got a letter from arc debt collectors and they have been phoning me every since. I'm worried if I don't pay this is could go up and up so so would like to know if I should phone them up and agree to pay it up.

    Thanks

If you could post the actual letter on the thread, I'll try to help.

Erm, do you owe this money or not? Have you gone back to Swinton and asked what the heck is going on? If not, why not? Just an idea, tell Swinton (or better still write to Swinton) explaining that you were informed your account was clear and closed. Put the account in dispute with them and they will have to investigate. Also get them to recall your account from TM until such time as they get their records upto date and balanced. Or continue to play with TM and risk getting your credit file marked for the next six years. Your decision.

Swinton Insurance is known for making errors. So it is important that you go back to them and ask them to explain what is going on, as Alsagerman recommends. Do this asap.

Trevor Munn solicitors, appear to be rather fond of sending out such letters.
However, more than likely same are sent out by ARC.

Please report this harassment to Consumer Direct, the consumer arm of the Office of Fair Trading.

Perhaps, and only if you can afford to pay £10, make a SAR to swinton insurance!

You'd be better to report the matter directly to your local Trading Standards Department. Consumer Direct don't exist anymore as their service is now provided by CAB. Ask Swinton Insurance if they have a Consumer Credit Licence, then send an email complaint to enquiries@oft.gsi.gov.uk inserting the words CREDIT FITNESS in the subject box. This ensures the email is directed to the OFT's Credit Fitness Team. Give a clear and concise resume of your complaint. Also make contact with the FSA. Swinton is owned by MMA Insurance and MMA are FSA-regulated.

The use of the CAB raises some interesting questions - independence, accountability, and Data Protection.

Trevor Munn is a solicitor for rent. The so called letter will have been printed on the ARC Threatomatic. I wouldnt worry too much about it.
