  • hired van and debit card

I'm hoping for some opinions from the wiser heads than mine .
I hireed a van a few days ago , and unfortuantely damaged it . I'm not disputing that I owe them their excess. However I wasn't able to find the money immeditately and asked if they could wait until the start of next month when i get paid . Today i found that they have dbited my card, and after trying to take the whole amount which was declined they made six transactions breaing the amounts taken down to £100 or below. The company say that they are able to retain the card details and thought i had funds asthe smaller transactions went through . I feel this is sharp practicew as I had agreed to pay them by the 7th . This has left mewith not being able to pay any DD's and the account aver £400 overdrawn despite the fact that there is no O?D facility.

contact your bank and do a charge back as you did not authorise the debits, and that you account has no overdraft facility
    but be quick

tried that teh bank said that as i had paid by debit card and the transactions were guaranteed there was nothing they could do . Also I think the the transaction went through on the 19th ( I returned the van on the 18th .

Did the company agree to do that in writing? Is there anything in the paperwork that says that they can take it out in multiples of £100?

Why is £100.00 guaranteed when there is no money in the account? That is crazy rubbish by the bank.

What we agreed and I signed for isthat I would make the full payment by teh 8th of July which is one day after my pay day . It will make a huge hole in my finances but that's my fault for being stupid. Ho do I find out whish merchant services the company use. I'll post up a copy of the contract tomorrow for folks to look at.

You have said you asked if they would wait, did they agree to your request? Do you have any witnesses to the conversation?

I signed a small note to say that I would pay by the 8th of the month which they countersigned. They say they were correct in taking the money as teh note sasid by teh 7th not on the 7th

Well on the point of the agreement they may be right. But I have doubts about the method of taking the payment.
