  • Possible CCJ i don't know about?

    Hey guys, im new here so please be nice to me, im embarassed enough as it is

    ok, Halifax. took a loan out in 2009 to get a new car for work (Domicilary carer) koz its a job u need a car for.
    When i applied for the loan i was VERY honest about my job role etc as in I was on a 0 hour contract, but that I was well respected by the manager and was on a regular wage of 300-350 a week before tax. They said it was ok!!

    so i took details home, read through a few things, confused about PPI i took it into store and asked them will i be covered by this, again, explaining that I could be let go at any given time without notice (just stop giving you work basically). All i got realy from what I remember was "are you on their payroel", "YES", "then u should b ok".

    brill, took out the loan.

    4 months in the manager sadly lost her husband and was replaced. New manager = 5-6hours per week. lost my home, lost my cat, lost everything.
    I called PPI to explain and all I got was some snappy women with an accept saying "have u been made redundant", I said well in effect yes.
    "have u got a redundancy letter", "no, i explained my situation when i took out this loan" "nothing can be done without a redundancy letter"...........

    that was that!

    contacted halifax again got no help or advice, so I politely argued that I wasnt paying a thing until I had a new job and could afford to as that is what i took the PPI out for. I was getting 20-30 phone calls a day thereafter from their whatever department, I asnwerd once, told them I wasnt speaking to them, I had told them what was happening and I would be in touch when I was sorted.

    (i no it was the wrong way of doing it but i was abit nieve then!)

    anyways, long story short i ended up with £800 worth of bank charges even though I realy had done my damndest to stop any more charges (was adviced to up my overdraft to cover the charges, which i did, then got a charge for HAVING an overdraft which took me over it again and got even more was bloody rediculous). Eventually, after the birth of my daughter, A debtcollector came round, he was nice so i spoke to him. we arranged £20 per month for the overdraft and he told me the other debt (LOAN) was being delt with by another guy but I was to contact him should the other guy be abusive and he would come help me with arrangements. I was fine with that.

    moths went by, no man. no letters. no nothing.

    moved house, i have recieved 3 letter at my new address regarding an old credit card from the halifax aswel, which I am now paying back abit at a time, but Ive heard nothing about the loan..........


    does this not strike anybody as strange??? they obviosly know where i live so now im thinking have I got a CCJ at my old address after I moved out without even knowing!!!!! I cant get a credit check koz i only have a chashpoint card now im strict with my finances.

    Firstly there is nothing to be embarressed of, and everyone here is lovely promise!

    What i suggest is, I flag this to our PPI experts and say you need help claiming it back, also bring your attention to the Dealing With DCA stickies until they get to you

      omg im so stupid!

      will the PPI even matter because I havent payed the loan i only payed 3-4 months then couldnt pay anymore

      whats a DCA? lol i will get used to this i swear!! xxxxx

        omg im so so sorrry hun! your not stupid in the least! its me being here too long.

        A dca is a debt collection agency. if you paid ppi and it wasnt applicable you may be able to reclaim it, it costs nothing to ask someone here and its better than a poke with a sharp stick

              Hi again

              So so sorry to learn of your issues here.

              Okay, in regards of the loan, if it did have PPI added to it, and it was passed onto a collections company, then usually the PPI is added to the loan as one total sum, so in this case it's possible your still paying back for the ppi within the total, even if your only paying a little a month.

              I would therefore, first write to the collections business who are taking the payments and ask if they will send you details of the balance of the loan owing which includes PPI.

              We can take it from there.

              Because remember the PPI you may be paying for within the payments your making is worthless to you now, your not going to be able to make a claim for example for sickness/unemployment, or if your no longer employed, this policy (PPI) will not be suited to your requirements any longer.

              It's best to make sure on this, by writing to them as stated above first, if there is any PPI, even if you paid only a small amount for a few months, you can reclaim on that, and they can remove the remaining balance of the ppi from the loan, then there is less to pay back in the long run.

                it does make sense, however, im not paying anything lol i havent since they told me my PPI didnt' stand, and i haven't heard from them in........about a year??....no mayb abit longer than that!

                wouldnt even know who to contact now!!

                just baffled me with hearing from the debt agency for the credit card (which was 5 months ago now) but nothing from the loan, when theyre both from the same bank :S

                (the debt agency letter was the usual tishtosh, pay now in full or we may take you to court bla bla bla)

                anyways, me and my husband have been speaking and what we are going to do is as follows:

                - I am going back to full time work now I have finally persuaded a few family members to help me with childcare!!
                - going to save up as much money each month as possible from my wage
                - in about 6 months, going to go to the bank/debt agency (if one ever does come forward) and say thers £$£$£ amount of money, to clear the debts, take it or leave it

                its worked for my husband so fingers crossed it will work for me and we can start building a stable future for our lil girl, get a morgage and eventually win the lottery

                thanks for your help, tbh im relaxed about it all now because A- cant go to jail for it and B- they cant have what i havent got!!
