    Send the below letter:

    ACCOUNT IN DISPUTE

    Date:

    Ref:

    Dear Sir/Madam

    Thank you for your letter of xx/xx/xx, the contents of which have been noted.

    You have failed to respond to my legal request to supply me a true copy of the original Consumer Credit Agreement for the above account.

    On **DATE** I made a formal request for a true signed agreement for the alleged account under consumer credit Act 1974 s77/78. This was signed for and delivered on the **DATE**
    You have failed to comply with my request, and as such the account entered default on **DATE** (12+2 working days after you made the initial request).

    The document that you are obliged to send me is a true copy of the executed agreement that contained all of the prescribed terms, all other required terms and statutory notices and was signed by both your company and myself as defined in section 61(1) of CCA 74 and subsequent Statutory Instruments. If the executed agreement contained any reference to any other document, you are also obliged to send me a copy of that document. In addition a full statement of this account should have been sent to me detailing all debits and credits to the account.

    Furthermore, you are aware that the Consumer Credit Act allows 12 working days for a request for a true copy of a credit agreement to be carried out before you/your client enters into a default situation.

    This limit has expired.

    As you are no doubt aware section 78(6) states:

    If the creditor fails to comply with Subsection (1)

    (a) He is not entitled , while the default continues, to enforce the agreement.

    Therefore this account has become currently unenforceable at law.

    As you have failed to comply with a lawful request for a true, signed copy of the said agreement and other relevant documents mentioned in it, Failed to send a full statement of the account and Failed to provide any of the documentation requested. You will also be aware of the CPUTR 2008 and the OFT's guidelines on debt collection which state under the title Deceptive and/or unfair methods - Examples of unfair practices are as follows - 2.8

    (i) - 'Failing to investigate and/or provide details as appropriate, when a debt is queried or disputed, possibly resulting in debtors being wrongly pursued'

    (k) - 'Not ceasing collection activity whilst investigating a reasonable queried or disputed debt'

    Consequentially any legal action you pursue will be averred as both UNLAWFUL and VEXATIOUS.

    Furthermore I shall counterclaim that any such action constitutes unlawful harassment.

    I reserve the right to report your actions to any such regulatory authorities as I see fit.
    You have 21 days from receiving this letter to contact me with your intentions to resolve this matter which is now a formal complaint.


    I look forward to hearing from you. This should be in writing, I have no wish to correspond by telephone.

          Just ignore that letter, it is only detailing their procedure on how they handle compliants.

            Morning All,

            An update on this one and advice on what to do next! After requesting the CCA and sending a compalint letter I recieved a letter on the 25th June in response to the complaint stating they've requested the agreement from the client which they haven't yet provided and they're fully aware at this stage that the debt is unenforceable and the accounts been placed on hold. NB: It's been nearly 3 months since I requested the CCA.

            I arrived home yesterday to find a letter from 1st credit saying they have written to me on numerous occassions and the debt still remains unpaid and if they cannot agree payment terms then they will be left with no option but to pass the account to Connaught Collections to consider issue of a statutory demand. They kindly advise they would like to avoid this and have completed a DD mandate on my behalf that I just need to sign and return to them!

            It's like all my previous correspondence has been ignored?? or is this a last roll of the dice on their behalf before passing to someone else? Who are Connaught Collections?

            How should I respond?

              connaughts are part of 1st crud 4 people in a small office below 1st crud (I know this as I had a mate who was security guard for the building and go there for chats)

              they have refused to send your CCA so you are not in the wrong, they are write to them again reminding them that they have not complied with your request and if passed over to connaughts for a stat demand that the courts would not look kindly on their non complience I have the head of collections e mail address if you wish to mail him, if you wish I,ll dig it out. (apologies for the bad grammar here my keyboard on my lappie is just about shot LOL)

                Thanks for the reply. The email address of the head of collections would be good if you can find it. I have been sending everything by recorded delivery so far so I could email the letter and also send by normal post.

                Is this length of time to provide the CCA normal?

                  12+2 days is what they should have to get the CCA to you . the head of collections is Gavin flynn I couldn,t find his mail address but if you are writing adress it and aim it at him instead , as I said before my mate is security guard at the building and I have seen what he looks like and he is a right pretty boy with no spine and is disliked intensly by everyone.

                      pins LOL his nickname was brokeback mountain as he always wore tacky cowboy boots and one time we were chatting to our mate and someone we knew who worked for the other firm in the building we knew told us he walked in one day looking rather beat up and sore and told then that he had been set upon and beaten up by a gang

                        Hi there,

                        I've sent the letter responding as suggested and in the interim I've recieved another letter from 1st Credit offering a 5% discount off the outstanding balance if I pay it now before they pass to Connaught but still no credit agreement has been provided. Am I reading too much into this or do you think they don't have a copy of the agreement?

                          Hi All,

                          An update on this one and some advice required. I have recieved a letter today from 1st Credit along with a copy of the credit card agreement but with no signature box, signature or date of signature as they are stating that in accordance with the Consumer Credit (Cancellation Notices and Copies Of Documents) Regulations 1983 - Regulation 3(1) applies whereby the creditor is only obliged to send out a generic copy of the agreement and not the actual photocopy of the signed agreement?

                          This has confused me! How do I respond to this?

                            What they are saying is that its not a true copy, but reconstituted copy of what your agreement may have looked like. Which basically doesn't prove anything.

                            You should right back asking for a them to confirm if they have a true copy of the original signed agreement under the CPUTR 2008 - either labman or militant can provide you with a template letter.

                                Hi, Im in a similar situation and have reached the same stage as yourself. As with you I was digging around for the right stuff, but I did come across this site:



                                Pretty much everything seems to be there, Hope its usefull to you and anyone else here who are in a similar fix
