  • Letters from Capquest - Natwest

    Hi I have 2 debts with Natwest, and they have both now been passed and chased for a good while by Capquest, the constant letters have had all the normal stuff in it, the latest one states that they see no reason why i should not be making payments to them and they will be making the relevant checks to see if i am paying any of my other debts, and if i am they will take legal action against me as i am being prejudiced!!!! I am making payments to others and have actually paid 1 of my debts off!!!!,
    !) can they do this or is it just another threat tactic?
    I have also been receiving regular phone calls frm Bryan Carter Solicitors but they do not leave any message, are these connected?

    Just a threat, for a company whom you have paid off a debt to or making payments too, to share such data with cabot for a completely unrelated account would likely be a breach of data protection act. What Cabot will actually do is check your credit file and nothing more.

    If you can give us some details for these debts with natwest, such as type of debt e.g. bank account overdraft (state if due to bank charges) or if they are credit card or loan debts. Along with how old the debt is and when you last made any payment towards them, then we can help you further.

    As for Bryan Carter, yes they will probably be connected and he is a pain in the royal rear end, he is also known to issue claims at court but not send people the POC in order to get automatice default judgement against people. But they can easily be set aside, so don't let it worry you. You can also send bryan carter a letter telling them to communicate in writing as you deem their constant calls whether silent, or where no message was left as a breach of the protection from harassment act. Make a note of all the calls you received by noting the date and time of each call. On a personal note, i have kicked Bryan Carter into touch on more than one occasion, so seriously as a said above don't let it worry you.

        Sorry, i mentioned cabot in error should have said capquest. Eitherway they are both DCA's so it doesn't change anything legally from your perspective when dealing with this issue.

          I think you might be on the same threat cycle as me. I have just received more threats after months of silence when they had previously said court action was pending.

          As its over 6 yrs for mine i have ignored it, mine was also from nastywest.

            We have saved all the letters sent from capquest re a 600 pound debt they vary between stupid threats of what they can do to offers of discounts to pay debt of of 1/3rd or 1/2 off back to dont ignore them back to the threats and round again going on for 2 1/2 years strangely and thay know we never answered them by mail or phone they are sending to an adress from over a year ago since we left redirection of mail stops in may and we know the house is empty i think i might send each letter back in unstamped envelope marked PAYMENT ENCLOSED to wind em up are they so thick to beleive we would pay they dont even know we exist anymore ???????/

              Don't.

              Those jerks would probably try to use that as an acknowledgement of the alleged debt to stop it becoming statute barred.
