  • Trying to get judgement set aside

I have tried everywhere but cannot get help on this, so I will try here.

In august this year I applied for a job and part of being accepted was a credit search, the search turned up a CCJ which I had no idea about, the judgement was against me at an address I have never lived at.

I applied to have the judgement set aside but for some bizarre reason the notice of hearing was not sent to the address on my application but to another address, so I never realised there was a date for the hearing until a letter arrived from the creditor adding another £120.

I then applied again, I managed to recieve the hearing date and attended, the creditor supplied a letter addressed to me at an address I once lived at but the address was not exactly correct, despite this the court refused to set aside the judgement.

This debt is not mine and if I could get hold of the credit agreement it would prove it is not me.

    Can anyone help me?

What details do you have on the CCJ? Have you sought to get information from the company that got the CCJ against you?

Appeal the refusal of the court to set aside judgement in default. You need ot show that you have a defence you would want to make had you known about the hearing. It sounds as if you can do this ?

ok, this sounds positive. I presume I get an N244 I do not want to appear as a vexatious litigant so I have to make sure my appeal will get this set aside and get a copy of the agreement to prove this debt is not mine. Do you have anysuggestions. Also I did have a hearing after the first one which I did not realilse had happened, but the creditor produced this letter which they claimed was sent to me, I was asked if I had recieved I said no but that wasnt good enough to have this set aside
