  • more lowell and littlewoods trouble

    hi guys an gals
    i'll try to keep it short an sweet as it seems to be same sort of problem as most in the lowell thread

    basically had account with LW (in my name) split with partner leaving me a single dad with 2 kids and 5k outstanding with them rung them told them what had happened offered what i could afford they said they wanted more( a lot more) and passed the account to NDR MONEY which i believe is just another department of LW so did same told what i can afford they said the minimum they could accept (strangely enough same amount as LW) they sent a couple more letters (none of which were conformation of their refusal to my offer which i had requested) then nothing for 2 months then i get a letter from lowell portfolio page 1 saying the debt had been sold to them page 2 with their details on how to pay 2 weeks later a letter from lowell financial saying the same pay now or set up dd or legal proceedings or home visit will start

    would sending the cca request be the way to go?

    thanks in advance for any advice

    just quick update received reply from lowells saying that they will endeavour to supply the request information within the 12 days but this will depend on receipt of the info from original creditor (littlewoods) and will advise me if it will take longer ( shudn't they already have all the information if they have bought the debt?) but they do state that all future correspondence will be in writing, and that they issued a letter of assignment when they bought the debt which fulfills their legal obligations under the property act 1925 and would only issue a specific deed of assignment if the matter proceeds to court action (is that right?)

            What Clever means is - Sit back and wait while they scrabble like a wild herd of desperate cattle to get the CCA.

                  They will only come up with a cobbled together CCA and have the audacity to say its original and hoping you don't know what a true copy looks like
                  I'm arguing the point at the mo that the original could not be supplied by Shop Direct so how did they get a copy and guess what they are now passing me down the line of desks at Lowells and its the seriously overdue department I'm with at present who are going to take my house send in bailiffs oh and take one of my kidneys
                  So be warned then you can ignore all the tosh too

                    When they start passing it on to the next desk, it usually means 1 of 2 things:

                    1 - they know the debt is unenforceable

                    or

                    2 - They do not have enough brain cells to put together a legal claim that would counter your arguments that its not yours, you have already paid, you don't owe anything or invalid DN and invalid agreement.

                    In otherwords, them passing it to the next desk along is more of a good sign then it is a bad sign.

                          just a quickie to let you all know since the cca request only received a few letters from Lowell saying that they are waiting for shop direct although todays letter said they would not contact me again until they have it should i send a sar to littlewoods to see exactly what they got or wait and see if Lowells get back in touch ?? as usual any advice gratefully received :beagle:

                            I'd ignore Lowells personally anyway no matter weather they do or dont provide a cca - there's nothing these clowns can or will do anyway.
                            Simply report them to the OFT & trading standards if they refuse to leave you alone.

                              It would seem as though lowells have finally realised that their is no CCA coming from littlewoods and as such they can not enforce or pursue you for the debt.

                              Sending a SAR to Littlewoods, would bring up some useful evidence and documents no doubt, but it could also include the CCA, which would then give cause for lowell to keep pursuing you. So basically do nothing, and do not send a SAR to littlewoods - Just sit back and enjoy the peace and quiet for now.

                              Though watch out for lowell passing the debt to Red (next desk along in their office) and when they do report lowell and red to OFT for passing on an unenforceable debt whilst in default of your cca request.
