littlewoods/lowells charges, help please.

Hello everyone i rather foolishly bought a digicam from littlewoods a couple of years ago over 2 years payments,
all seemed well but after a few years payments i thought i had paid it off,
if only! the oustanding debt hardly ever seemed to come down, however before i moved house i made a couple of large payments which i thought cleared the outstanding balance,
shortly after moving into my new house i start to get letters from lowells saying they want nearly 200 pounds from me re my littlewoods account, i said to them it must be a mistake as i had always paid my monthly payements so they said they would look into it and today i recieved a breakdown of my payements to littlewoods, deep breath from me now, i paid littlewoods 1100 pounds for a 300 pound camera! i told lowells i am not paying anymore and they are now threating
legal action against me, any help much appreciated.

I would ignore Lowells for the moment - they have no powers to demand anything from you. Meanwhile I think you have two immediate choices - the first is to ask for a copy of the original CCA; the second is to send a SAR requesting all information they hold about you - this should include the CCA and a detailed breakdown of the charges. You can then see exactly where you stand.

Is there a template letter for reclaiming the charges?

I would write to them with the SAR which will allow you to identify all charges which could potentially be reclaimed. In the same letter I would say you are formally disputing the debt, and ask them to freeze all further interest and charges while the dispute is resolved.

A Lowell legal threat is worthless - just beware of letters from Red or Hampton Legal (same company)

Sitting Duck,

Were you making the minimum agreed weekly/monthly repayments on time as per agreed at the time of purchase, if so then there is no debt. I suspect that if you paid on the date each payment was due by, then because it takes 2-3 days to clear into littlewoods account, then their system picked it up as a late payment and added late payment charges to the account - Hence how the debt spiralled.

Though such charges can be reclaimed and it maybe that you paid more as a result of the interest on such charges. So you need to reclaim the interest on the charges too. In fact reclaim all monies above the agreed original price of the item as per your agreed payment plan (Thats the items original price plus the interest rate for the 2 year payment plan i believe).

Yes that is what happened with most of the charges i do believe, i thought i was paying them on time but didn't realise that with the littlewoods clearing time that they were being deemed `late` payements, however there were probably one or two payements that i did pay late.
